- The second proposal is that there should be a five-year time-bar on the recovery of sums owed to the Community. This limit could be extended in cases where active steps are being taken to secure recovery. As things stand, there is no general time-limit of a ‘Community’ nature (such a limit exists in certain sectoral regulations e.g. those concerning the Staff Regulations: 5 years, the regulation on the protection of the communities’ financial interests: 4 years). Nor is it clear whether after the period has elapsed it is possible to accept compensation or spontaneous payment by the debtor. In brief, this proposal would introduce legal certainty for both the institutions and the debtors.

Reaffirms paragraph 2 of its abovementioned resolution of 16 May 2000 on protecting the Communities' financial interests and calls on the Commission, as a preliminary step, to present, on the basis of the current Article 280 of the EC Treaty, a proposal to extend Regulation (EC) No 1073/1999 concerning investigations conducted by the European Anti-Fraud Office (OLAF) , which would allow the early appointment of such a public prosecutor, whose jurisdiction would be limited, pending the entry into force of the envisaged changes to the Treaty, to criminal offences against the financial interests of the European Communities committed by members and employees of the EU institutions and who would have the task of heading the related OLAF investigations and facilitating the prosecution of such criminal offences in the appropriate national courts;
