L. whereas, in lack of an effective EU control mechanism, Israeli settlement products continue to arrive on the European market under preferential treatment; whereas the European Parliament, in its resolution on the proposal for a Council decision on the conclusion of the regional Convention on pan-Euro-Mediterranean preferential rules of origin of 16 February 2012, expressed its serious concern about the practices employed by certain companies in exploiting the terms of the EU-Israel Association Agreement by exporting goods produced in the occupied Palestinian Territory to the European market under preferential treatment, noted that the solutions offered by the relating technical arrangement between the EU and Israel were not satisfactory in this regard, considered that a simple, efficient and reliable mechanism to replace this arrangement should be agreed with Israel, urged however Member States to ensure that their customs authorities effectively apply the existing technical arrangement, and invited the Commission to put forward new proposals and to work together with the European Parliament to find a solution to this abuse of preferential access to the Union’s internal market;
L. considérant qu'en l'absence de mécanisme de contrôle efficace de l'Union européenne, les produits issus des colonies israéliennes continuent d'arriver sur le marché européen en bénéficiant d'un traitement préférentiel; considérant que le Parlement européen, dans sa résolution du 16 février 2012 sur la proposition de décision du Conseil relative à la conclusion de la convention régionale sur les règles d'origine préférentielles paneuroméditerranéennes, s'inquiète vivement des pratiques utilisées par certaines entreprises qui persistent à tirer profit des dispositions de l'accord d'association UE-Israël en exportant des biens produits dans les territoires occupés, note que les solutions apportées par les arrangements techniques en la matière en l'Union et Israël ne sont pas satisfaisantes à cet égard, estime qu'il conviendrait de s'accorder avec Israël pour remplacer cet arrangement par un mécanisme simple, efficace et fiable, invite toutefois instamment les États membres à s'assurer que leurs autorités douanières appliquent effectivement l'arrangement technique existant, et invite la Commission à présenter de nouvelles propositions et à coopérer avec le Parlement européen pour trouver une solution à cet abus de l'accès préférentiel au marché intérieur de l'Union;

10. Is seriously concerned about the practices employed by certain companies which persist in exploiting the terms of the EU-Israel Association Agreement by exporting goods produced in the Occupied Territories; deplores this practice and considers that it flies in the face of the EU’s international policies and represents an abuse of the extensive opportunities for legitimate preferential access to the Union's internal market; therefore calls on the Commission to draw up a blacklist of companies which persist in employing these practices and to inform the Member States;

Where any producer from the People's Republic of China provides sufficient evidence to the Commission that it did not export the goods described in Article 1(1) originating in the People's Republic of China during the period of investigation (1 October 2010 to 30 September 2011); that it is not related to an exporter or producer subject to the measures imposed by this Regulation; and that it has either actually exported the goods concerned or has entered into an irrevocable contractual obligation to export a significant quantity to the Union after the end of the period of investigation, the Council, acting by simple majority on a proposal by the Commission, after consulting the Advisory Committee, may amend Article 1(2) in order to attribute to that producer the duty applicable to cooperating producers not in the sample.
Si un producteur de la République populaire de Chine fournit à la Commission des éléments de preuve suffisants montrant qu'il n'a pas exporté, au cours de la période d'enquête (du 1er octobre 2010 au 30 septembre 2011), les marchandises visées à l'article 1er, paragraphe 1, originaires de la République populaire de Chine, qu'il n'est lié ni à un exportateur ni à un producteur soumis aux mesures instituées par le présent règlement et qu'il a, soit effectivement exporté les marchandises concernées, soit s'est engagé d'une manière irrévocable par contrat à exporter une quantité importante vers l'Union après la fin de la période d'enquête, le Conseil, statuant à la majorité simple sur proposition de la Commission, peut, après avoir consulté le comité consultatif, modifier l'article 1er, paragraphe 2, afin d'appliquer à ce producteur le taux de droit applicable aux producteurs ayant coopéré, mais non retenus dans l'échantillon.

5. Urges the Commission and the ACP countries to make best use of the funding available for Aid for Trade in order to support the reform process in areas essential for economic development; to improve infrastructure where it is necessary, as the opportunities offered by the EPAs can only be fully taken advantage of if strong accompanying measures are introduced for the ACP countries; to compensate the net loss of customs revenue and encourage tax reform so that public investments in social sectors are not reduced; to invest in the production chain in order to diversify export production; to produce more higher added-value export goods; and to invest in training and support for small producers and exporters to meet EU sanitary and phytosanitary criteria;

Where any party from the USA provides sufficient evidence to the Commission that it did not export the goods described in Article 1(1) originating in the USA during the period of investigation (1 April 2007-31 March 2008) that it is not related to an exporter or producer subject to the measures imposed by this Regulation; and that it has either actually exported the goods concerned or has entered into an irrevocable contractual obligation to export a significant quantity to the Community after the end of the period of investigation, the Council, acting by simple majority on a proposal by the Commission, after consulting the Advisory Committee, may amend Article 1(2) in order to attribute to that party the duty applicable to cooperating producers not in the sample, i.e. EUR 115,6 per tonne.
