Welcomes the main initiatives taken by the Commission, at Parliament’s request, to shape a new EU legislative landscape for anti-fraud policy, and in particular the proposal for a directive on the fight against fraud to the Union’s financial interests by means of criminal law, which aims to clarify and harmonise Member States’ provisions in criminal law on offences related to the EU budget (COM(2012)0363), the proposal for a Council regulation on the establishment of the European Public Prosecutor’s Office (COM(2013)0534), and the proposal for a regulation on the European Union Agency for Criminal Justice Cooperation (Eurojust) (COM(2013)0535), as well as the amendment to Regulation (EC) No 1073/1999 concerning investigations conducted by the European Anti-Fraud Office (OLAF) and stronger legal rights for persons concerned by OLAF investigations; recognises the importance for these different pieces of legislation to be well calibrated and thoroughly evaluated; calls on the Council to take the necessary time and not to finalise negotiations in a rush, in order to develop a robust European legal framework and strengthen the existing institutional tools for protecting the Union’s financial interests; stresses that a premature transition to the enhanced cooperation procedure should be avoided; welcomes also the action plan to step up the fight against tax fraud and tax evasion, as well as VAT reform in the EU, both efforts having been initiated in 2011;

The EU's institutions, agencies and existing cooperation tools already provide an effective set of instruments to make EU security policy an operational reality.

Legal transposition should be ensured using, to their fullest extent, wherever necessary, existing institutional tools.

Given the limitations of the existing international monitoring and evaluation mechanisms explained above, a specific EU monitoring and assessment mechanism, the EU Anti-Corruption Report, should be established to prompt stronger political will in the Member States and enforcement of the existing legal and institutional tools.

(80)The Commission should be empowered to adopt delegated acts in accordance with Article 290 of the Treaty on the Functioning of the European Union in order to: specify the definitions of "critical functions" and "core business lines", specify the circumstances when an institution is failing or likely to fail, specify the circumstances when the asset separation tool should be applied, specify the liabilities excluded from the scope of application of the bail-in tool, specify the circumstances when exclusion from the bail-in tool is necessary to ensure the continuation of critical operations and core business lines, specify the criteria for the determination of the minimum amount of eligible liabilities required from institutions for the purposes of the bail in tool, specify the circumstances when, in application of the bail-in tool, existing shares should be cancelled and liabilities should be converted into shares, specify the circumstances when third country resolution proceedings should not be recognised, further specify the conditions under which it should be considered that the target level of the financing arrangements has significantly deviated from the initial level, adopt criteria aimed at adjusting the contributions to the financing arrangements to the risk profile of institutions, define obligations aimed at ensuring the effective payment of the contributions to the financing arrangements and specify the conditions for the mutual borrowing between national financing arrangements.
(80)La Commission devrait être habilitée à adopter des actes délégués, conformément à l’article 290 du traité sur le fonctionnement de l’Union européenne, aux fins suivantes: préciser la définition des «fonctions critiques» et des «activités fondamentales»; préciser les circonstances dans lesquelles la défaillance d'un établissement est avérée ou prévisible; préciser les circonstances dans lesquelles il y a lieu de recourir à l’instrument de séparation des actifs; préciser les engagements exclus du champ d’application de l’instrument de renflouement interne; préciser les circonstances nécessitant une exclusion du champ d'application de cet instrument afin d'assurer la poursuite d'opérations critiques et d'activités fondamentales; préciser les critères de détermination du montant minimal d'engagements ou de passifs éligibles imposé aux établissements pour l’application de cet instrument; préciser les circonstances dans lesquelles, lors du recours à cet instrument, il y a lieu d'annuler des actions ou de convertir des créances en actions; préciser les circonstances dans lesquelles une procédure de résolution de pays tiers ne devraient pas être reconnue; préciser davantage les conditions dans lesquelles il y a lieu de considérer que le niveau cible des dispositifs de financement présente un écart important par rapport au niveau initial; adopter des critères permettant d'adapter au profil de risque des établissements les contributions aux dispositifs de financement; définir des obligations visant à garantir le paiement effectif des contributions aux dispositifs de financement; et préciser les conditions d’emprunt mutuel entre les dispositifs de financement nationaux.

(7) The feasibility study carried out for the Commission concluded that there is a clear role for a European Institute for Gender Equality to carry out some of the tasks with which the existing institutions do not currently deal, specifically in the areas of coordination, centralisation and dissemination of research data and information, network building, the raising of visibility of equality between men and women, highlighting the gender perspective and the development of tools for improved integration of gender equality in all Community policies.
