70 (1) Where an employer and a bargaining agent have executed a collective agreement or are bound by an arbitral award and the employer or the bargaining agent seeks to enforce an obligation that is alleged to arise out of the agreement or award, and the obligation, if any, is not one the enforcement of which may be the subject of a grievance of an employee in the bargaining unit to which the collective agreement or arbitral award applies, either the employer or the bargaining agent may, in the prescribed manner, refer the matter to the Board.

49 (1) Either party to a collective agreement may, within the period of four months immediately preceding the date of expiration of the term of the collective agreement, or within the longer period that may be provided for in the collective agreement, by notice, require the other party to the collective agreement to commence collective bargaining for the purpose of renewing or revising the collective agreement or entering into a new collective agreement.

(2) The collective agreement, as amended by or pursuant to this Act, is effective and binding on the parties to the collective agreement for the period for which the collective agreement is extended by subsection (1) notwithstanding anything in Part I of the Canada Labour Code or in the collective agreement, and Part I of that Act applies in respect of the collective agreement, as so amended, as if that period were the term of the collective agreement.
