B. whereas Mr Haythan Al-Maleh, an 80 year-old Syrian human rights lawyer, was arrested by officers of the General Intelligence Service on 14 October 2009, held incommunicado until his interrogation by the Military Prosecutor on 20 October 2009, and sentenced by the Second Military Court of Damascus on 4 July 2010 to three years of imprisonment on the grounds of ‘transferring false and exaggerated news that weaken national sentiments’ under Articles 285 and 286 of the Syrian Criminal Code, despite the fact that military tribunals should not have competence to try civilians,
B. considérant que M. Haytham al-Maleh, avocat syrien de 80 ans spécialisé dans les droits de l'homme, a été arrêté le 14 octobre 2009 par les services généraux du renseignement, détenu au secret jusqu'à son interrogatoire par le procureur militaire le 20 octobre 2009 et condamné, le 4 juillet 2010, par le second tribunal militaire de Damas à trois ans d'emprisonnement en application des articles 285 et 286 du code pénal syrien, au motif qu'il a «véhiculé des informations fallacieuses et exagérées qui portent atteinte aux sentiments nationaux», alors que les tribunaux militaires ne sont pas habilités à juger des civils,
