– having regard to the agreement within the Council on the implementing Regulation specifying uniform conditions of application of Regulation (EU) No 806/2014 of the European Parliament and of the Council with regard to ex-ante contributions to the Single Resolution Fund (COM(2014)0710),
– vu l'accord intervenu au sein du Conseil sur le règlement d'exécution définissant des conditions uniformes d'application du règlement (UE) n° 806/2014 du Parlement européen et du Conseil en ce qui concerne les contributions ex ante au Fonds de résolution unique (COM(2014)0710),

I. whereas the agreement within the Council on the implementing regulation specifying uniform conditions of application of Regulation (EU) No 806/2014 of the European Parliament and of the Council with regard to ex-ante contributions to the Single Resolution Fund, reached after an informal involvement of Parliament, is consistent with the above delegated regulation;
I. considérant que l'accord intervenu au sein du Conseil sur le règlement d'exécution définissant des conditions uniformes d'application du règlement (UE) n° 806/2014 du Parlement européen et du Conseil en ce qui concerne les contributions ex ante au Fonds de résolution unique, qui a été obtenu avec la participation informelle du Parlement, est cohérent avec le règlement délégué à l'examen;

E. whereas on 21 October 2014, in order to satisfy the latter empowerment, the Commission adopted the Commission delegated regulation supplementing Directive 2014/59/EU of the European Parliament and the Council of 15 May 2014 with regard to ex ante contributions to resolution financing arrangements;
E. considérant que, faisant usage de cette disposition, la Commission a adopté, le 21 octobre 2014, le règlement délégué de la Commission complétant la directive 2014/59/UE du Parlement européen et du Conseil du 15 mai 2014 en ce qui concerne les contributions ex ante aux dispositifs de financement pour la résolution;

By way of derogation from the rule that the calculation of contributions should be performed at individual level, in the case of a central body with credit institutions affiliated to it that are wholly or partially exempted from prudential requirements in national law in accordance with Article 10 of Regulation (EU) No 575/2013 of the European Parliament and of the Council, the rules on ex ante contributions should only apply to the central body and the affiliated credit institutions as a whole on a consolidated basis because the solvency and liquidity of the central body and of all the affiliated institutions are monitored as a whole on the basis of consolidated accounts of these institutions.
Par dérogation à la règle prévoyant que les contributions doivent être calculées au niveau individuel, dans le cas d'un organisme central dont les établissements de crédit affiliés sont totalement ou partiellement exemptés des exigences prudentielles dans le droit national sur la base de l'article 10 du règlement (UE) no 575/2013 du Parlement européen et du Conseil, les règles concernant les contributions ex ante ne doivent s'appliquer que sur une base consolidée à l'organisme central et à ses établissements de crédit affiliés dans leur ensemble, puisque la solvabilité et la liquidité de l'organisme central et de tous les établissements affiliés sont suivies dans leur ensemble sur la base des comptes consolidés de ces établissements.

Where participating Member States have already established national resolution financing arrangements, they should be able to provide that the national resolution financing arrangements use their available financial means, collected from entities in the past by way of ex-ante contributions, to compensate entities for the ex-ante contributions which those entities should pay into the Fund.
Lorsque les États membres participants ont déjà établi des dispositifs nationaux de financement pour la résolution, ils devraient pouvoir prévoir que ces dispositifs utilisent leurs moyens financiers disponibles, collectés dans le passé auprès des entités sous la forme de contributions ex ante, pour dédommager les mêmes entités des contributions ex ante qu'elles devraient verser au Fonds.
