Definition: A transient disorder that develops in an individual without any other apparent mental disorder in response to exceptional physical and mental stress and that usually subsides within hours or days. Individual vulnerability and coping capacity play a role in the occurrence and severity of acute stress reactions. The symptoms show a typically mixed and changing picture and include an initial state of daze with some constriction of the field of consciousness and narrowing of attention, inability to comprehend stimuli, and disorientation. This state may be followed either by further withdrawal from the surrounding situation (to the extent of a dissociative stupor - F44.2), or by agitation and over-activity (flight reaction or fugue). Autonomic signs of panic anxiety (tachycardia, sweating, flushing) are commonly present. Stéphane Dion: With regard to the Joint Strike Fighter (JSF) program, since the beginning of Canada's participation: (a) what are the criteria (operational requirements, contractual conditions, etc) on which the government is selecting the F-35s as a replacement for the CF-18s; (b) when and by whom were those criteria determined; (c) what are the relevant studies which were conducted prior to determining those criteria, specifying the (i) dates, (ii) names of the studies, (iii) names of individuals requesting the studies, (iv) authors of the studies, (v) names of the individuals presented with the results; (d) before those criteria were determined, on the basis of what information did the government evaluate that the F-35 could satisfy Canada's needs; (e) since the beginning of Canada's participation in the JSF program, what were all the studies conducted that evaluated different fighter planes in relation to Canada's needs, specifying the (i) dates, (ii) names of the studies, (iii) names of individuals requesting the studies, (iv) authors of the studies, (v) studies which were used to evaluate the planes, (vi) names of the individuals who determined those criteria, (vii) planes which were considered in the study, (viii) names of the individuals presented with the results; (f) what is the operational availability of a fleet of 65 fighter jets; (g) what effect will a reduction in Canada's fleet of fighter jets have on operational capability, on Canada's ability to play its role within the North American Aerospace Defence Command (NORAD) and on the distribution of fighter jets across Canada's military bases; (h) how did the government determine that Canadian Forces needed 65 planes; (i) what is the formula used to determine the number of planes Canada should buy and who is the author of that formula; (j) for each of the variables in that formula, how was the value of that variable determined, specifying by whom, based on ...

In that connection, although the Civil Service Tribunal, accepted that it was not for it to determine the items of information which the Commission must communicate to the person concerned in order to satisfy its obligation to state reasons, it observed, in particular, that certain additional particulars, such as the intermediate marks for each of the assessment criteria laid down in the notice of competition and the evaluation sheets, could have been sent to Mr Meierhofer with any items of information covered by the secrecy of the selection board’s proceedings blacked out without disclosing either the attitudes adopted by individual members of the selection board or any factors relating to individual or comparative assessments of candidates (paragraphs 50 and 51 of the judgment under appeal).

Meierhofer sans divulgation ni des attitudes prises par les membres individuels du jury, ni d’éléments ayant trait à des appréciations de caractère personnel ou comparatif concernant les candidats (points 50 et 51 de l’arrêt attaqué).

The obligations on the Member States to report on the practical implementation and on the Commission to draw up a report on the basis of the national reports are an important part of the legislative cycle, providing the opportunity to take stock of and evaluate the various aspects of the practical implementation of the Directives; it is therefore appropriate to extend this obligation to those directives that do not require reports, namely: Directive 2000/54/EC of the Parliament and of the European Council of 18 September 2000 on the protection of workers from risks related to exposure to biological agents at work (seventh individual Directive within the meaning of Article 16(1) of Directive 89/391/EEC) , Directive 2004/37/EC of the European Parliament and of the Council of 29 April 2004 on the protection of workers from the risks related to exposure to carcinogens or mutagens at work (sixth individual Directive within the meaning of Article 16(1) of Directive 89/391/EEC) and Council Directive 83/477/EEC of 19 September 1983 on the protection of workers from the risks related to exposure to asbestos at work (second individual Directive within the meaning of Article 8 of Directive 80/1107/EEC)
Les obligations imposées à la fois aux États membres de faire rapport sur la mise en œuvre pratique et à la Commission d’en faire sur la base des rapports nationaux constituent un moment important du cycle législatif qui permettent d’effectuer un bilan et une évaluation des différents aspects de la mise en œuvre pratique des dispositions des directives; il convient dès lors d’élargir cette obligation aux directives qui ne prévoient pas l’établissement de rapports, à savoir: la directive 2000/54/CE du Parlement européen et du Conseil, du 18 septembre 2000, concernant la protection des travailleurs contre les risques liés à l’exposition à des agents biologiques au travail (septième directive particulière au sens de l’article 16, paragraphe 1, de la directive 89/391/CEE) , la directive 2004/37/CE du Parlement européen et du Conseil, du 29 avril 2004, concernant la protection des travailleurs contre les risques liés à l’exposition à des agents cancérigènes ou mutagènes au travail (sixième directive particulière au sens de l’article 16, paragraphe 1, de la directive 89/391/CEE) , ainsi que la directive 83/477/CEE du Conseil, du 19 septembre 1983, concernant la protection des travailleurs contre les risques liés à une exposition à l’amiante pendant le travail (deuxième directive particulière au sens de l’article 8 de la directive 80/1107/CEE)
