The process of restructuring in the defence and aerospace industries has led to an increasing number of mergers and other cooperative agreements between companies within the European Union.

In 2009, following a public consultation, the Commission submitted a report to the Council containing a limited stocktaking exercise which concerned the allocation of cases between the Commission and Member States ("the 2009 Report").[17] In the public consultation, stakeholders stated that diverging merger rules and practices within the European Union may add to the administrative burden on business and lead to ineffective merger control enforcement, inconsistent outcomes, and an adverse impact on the internal market.
