The technical specifications are coherent as they do not conflict with European standards, that is to say they cover domains where the adoption of new European standards is not foreseen within a reasonable period, where existing standards have not gained market uptake or where these standards have become obsolete, and where the transposition of the technical specifications into European standardisation deliverables is not foreseen within a reasonable period.

Emphasises that standards should be comprehensible, simple and easy to use so that they can be implemented better by users; considers it essential to reduce, where appropriate, the excessive number of cross-references between standards, and to address current difficulties in identifying the group of standards relevant to a given product or process; calls on the national and European standards bodies and trade associations to provide user-friendly guidelines for the use of standards, free online abstracts, better online access to consultation drafts and simple electronic search functions;

Should contracting authorities/entities, in the cases referred to in Article 42(1)(f), require the production of certificates drawn up by independent bodies attesting the compliance of the economic operator with certain environmental management standards, they shall refer to the Community Eco-Management and Audit Scheme (EMAS) or to environmental management standards based on the relevant European or international standards certified by bodies conforming to Community law or the relevant European or international standards concerning certification.

Where contracting authorities require the production of certificates drawn up by independent bodies attesting the compliance of the economic operator with certain environmental management standards, they shall refer to the Community Eco-Management and Audit Scheme (EMAS) provided for in Regulation (EC) No 761/2001 of the European Parliament and of the Council (8) or to environmental management standards based on the relevant European or international standards certified by bodies conforming to Community law or the relevant European or international standards concerning certification.
3 ter. In such cases, should the contracting entities require the production of certificates drawn up by independent bodies attesting the compliance of the economic operator with certain environmental management standards, they shall refer to the EMAS or to environmental management standards based on the relevant European or international standards certified by bodies conforming to Community law or the relevant European or international standards concerning certification.

Where international standards exist, Member States shall encourage the European standards organisations to use them, or the relevant parts of them, as a basis for the standards they develop, except where such international standards or relevant parts would be ineffective.
Dans les cas où il existe déjà des normes internationales, les États membres encouragent les organismes européens de normalisation à utiliser ces normes ou leurs éléments pertinents comme fondement des normes qu'ils élaborent, sauf lorsque ces normes internationales ou leurs éléments pertinents seraient inopérants.

5. Where the contracting authorities make use of the possibility provided for in point (b) of paragraph 3, of prescribing specifications in terms of performance or of functional requirements, they may not reject a tender which complies with a national standard transposing a European standard, a European technical approval or common technical specifications, an international standard or technical reference material produced by a European standards body, if those specifications relate to the necessary performance or functional requirements.
5. Lorsque les pouvoirs adjudicateurs font usage de la possibilité, prévue au paragraphe 3, point b), de prescrire des spécifications en termes de performances ou d'exigences fonctionnelles, ils ne peuvent rejeter une offre conforme à une norme nationale transposant une norme européenne, à un agrément technique européen, à une spécification technique commune, à une norme internationale ou à un référentiel technique élaboré par un organisme européen de normalisation, si ces spécifications visent les performances ou les exigences fonctionnelles requises.
