1. With a view to ensuring that the amounts for the financing of the market related expenditure and direct payments of the CAP currently under heading 2 of Annex I to the Interinstitutional Agreement between the European Parliament, the Council and the Commission on budgetary discipline and sound financial management respect the annual ceilings set out in the Decision 2002/929/EC of the Representatives of the Governments of the Member States, meeting within the Council of 18 November 2002, concerning the Conclusions of the European Council meeting in Brussels on 24 and 25 October 2002 , an adjustment of the direct payments shall be determined when the forecasts for the financing of the aforementioned measures under heading 2 for a given financial year, increased by the amounts given in Articles 134 and 135 of this Regulation and before application of modulation provided for in Articles 7 and 10 of this Regulation and Article 1(1) of Regulation (EC) No 378/2007, indicate that the applicable abovementioned annual ceiling, taking into account a margin of EUR 300 000 000 below that ceiling, will be exceeded.

Pour veiller à ce que les montants destinés à financer les dépenses de marché et des paiements directs dans le cadre de la PAC, figurant actuellement à la rubrique 2 de l'annexe I de l'accord interinstitutionnel entre le Parlement européen, le Conseil et la Commission sur la discipline budgétaire et la bonne gestion financière , respectent les plafonds annuels fixés par la décision 2002/929/CE des représentants des gouvernements des États membres, réunis au sein du Conseil le 18 novembre 2002, concernant les conclusions du Conseil européen réuni à Bruxelles les 24 et 25 octobre 2002 , un ajustement des paiements directs est décidé lorsque, pour un exercice donné, les prévisions de financement desdits paiements au titre de la rubrique 2, augmentées des montants fixés aux articles 134 et 135 du présent règlement et avant application de la modulation prévue aux articles 7 et 10 du présent règlement ainsi qu'à l'article 1er, paragraphe 1, du règlement (CE) no 378/2007, indiquent que le plafond annuel susmentionné applicable sera dépassé, compte tenu d'une marge de 300 millions EUR en dessous de ce plafond.

The Council's second reading has given rise to the following changes as compared with the results of the first reading on 17 July with regard to Headings 1 (agricultural expenditure) and 2 (Structural Funds): Heading 1 (agricultural expenditure) an increase of EUR 513 million following the adoption of Letter of Amendment No 1, but with a targeted reduction by the same amount; Heading 2 (Structural Funds) reduction of EUR 500 million in p/a (and, as compared with the results of the European Parliament's first reading, the return to the relevant budget headings of EUR 1500 million in c/a and EUR 250 million in p/a placed in the reserve by the European Parliament).
Par rapport aux résultats de la première lecture du 17 juillet, il convient de souligner notamment les modifications suivantes concernant les rubriques 1 (dépenses agricoles) et 2 (Fonds structurels) résultant de la deuxième lecture du Conseil : Rubrique 1 (dépenses agricoles) - augmentation de 513 millions euro suite à l'adoption de la lettre rectificative n 1, en revanche réduction de manière ciblée d'un même montant de 513 millions euro ; Rubrique 2 (Fonds structurels) - réduction de 500 millions euro en c/p (et, par rapport à la première lecture du Parlement, remise à la ligne de 1500 millions euro en c/e et de 250 millions euro en c/p mis en réserve par le Parlement).
