The European Ombudsman and the Ombudsman of Ireland (the now European Ombudsman) jointly organised the 9th National Seminar of the Network. This seminar took place in Dublin from 15 to 17 September 2013.

The post of European Ombudsman was established in the Treaty of Maastricht in 1992, creating an intermediary between European citizens and the authorities of the European Union. European citizens and businesses, but also institutions and any individual who lives or is legally resident in a Member State, are entitled to lodge complaints with the Ombudsman.

U. The Ombudsman and the Committee on Petitions have received many petitions and approaches from citizens citing the Charter, although there are numerous apparent misunderstandings of its scope or level of protection. Nevertheless they have been in the forefront of those who have actively deployed the Charter in the interests of the citizen. They have upheld complaints and used their powers of own initiative over discrimination in the recruitment and employment policies of the EU institutions in respect of age, sex, race, freedom of expression and parental leave. They also apply systematically the Code of Good Administrative Behaviour to seek to give effect to the provisions of the Charter. They consider that the Charter should be binding whenever Community law is being applied. The Committee on Petitions and the European Ombudsman and his network of national ombudsmen could play an important role in promoting and monitoring the implementation of the Charter, and the Ombudsman could be empowered to refer important fundamental rights cases to the Court of Justice;
U. tant la commission des pétitions que le Médiateur ont reçu de nombreuses pétitions et démarches émanant de citoyens invoquant la Charte, bien qu'apparemment les malentendus quant à sa portée ou au niveau de protection qu'elle assure soient nombreux; ils se sont néanmoins trouvés parmi les premiers à avoir utilisé activement la Charte dans l'intérêt du citoyen; ils ont soutenu leurs réclamations et fait usage de leurs pouvoirs d'initiative en ce qui concerne la discrimination dans les politiques de recrutement et d'emploi des institutions européennes, en termes d'âge, de sexe, de race, de liberté d'expression et de congé parental; ils appliquent également systématiquement le code de bonne conduite administrative pour tenter de mettre en oeuvre les dispositions de la Charte; ils considèrent qu'elle devrait être contraignante à chaque fois que le droit communautaire est appliqué; la commission des pétitions, ainsi que le Médiateur européen et son réseau de médiateurs nationaux pourraient jouer un rôle important dans le développement et le contrôle de la mise en oeuvre de la Charte et le Médiateur européen pourrait être habilité à saisir la Cour de justice de cas importants en relation avec les droits fondamentaux;

Allow me to say once again how much the Commission appreciates the excellent work undertaken by the European Ombudsman’s office, and how grateful it is for it. The Ombudsman himself, Mr Söderman, deserves particular recognition. He is the driving force and is largely responsible for the results and beneficial effects achieved by this new institution of the European Ombudsman. It has to be said that the citizens of Europe are daily becoming more familiar with it.
Je tiens à remercier et à reconnaître une fois encore, au nom de la Commission, l’excellent travail que réalise l’institution du médiateur européen et bien sûr tout particulièrement le médiateur lui-même, M. Söderman, qui dirige sans aucun doute les travaux et qui est en grande partie le moteur et l’explication des résultats et des conséquences positives qu’engendre la réalité du médiateur européen qui - disons-le clairement - est chaque jour plus connu des citoyens européens.
