The communication follows on from the European Council's declaration that Member States are looking forward to the Commission's proposals for strengthening and clarifying the implementation of the Stability and Growth Pact and takes account of the Court of Justice's judgment in Case C-27/04 Commission v Council of the European Union regarding the annulment of Council measures against Germany and France.
Cette communication fait suite à la déclaration du Conseil européen selon laquelle les États membres attendent avec intérêt les propositions de la Commission visant à renforcer et à clarifier la mise en œuvre du pacte de stabilité et de croissance.Elle tient compte de l'arrêt de la Cour de justice dans l'affaire C-27/04 qui oppose la Commission européenne et le Conseil concernant l'annulation des actes de celui-ci à l'égard de l'Allemagne et de la France.

The present Commission Communication follows up to the European Council assertion that Member States look forward to the proposals of the Commission with regard to strengthening and clarifying the implementation of the SGP.
La présente communication de la Commission fait suite à l'affirmation du Conseil européen selon laquelle les États membres attendent avec intérêt les propositions de la Commission visant à renforcer et à clarifier la mise en oeuvre du pacte de stabilité et de croissance.

(2) Whereas the Stability and Growth Pact consists of this Regulation which aims to strengthen the surveillance of budgetary positions and the surveillance and coordination of economic policies, of Council Regulation (EC) No 1467/97 (3) which aims to speed up and to clarify the implementation of the excessive deficit procedure and of the Resolution of the European Council of 17 June 1997 on the Stability and Growth Pact (4), in which, in accordance with Article D of the Treaty on European Union, firm political guidelines are issued in order to implement the Stability and Growth Pact in a strict and timely manner and in particular to adhere to the medium term objective of budgetary positions of close to balance or in surplus, to which all Member States are committed, and to take the corrective budgetary action they deem necessary to meet the objectives of their stability and convergence programmes, whenever they have information indicating actual or expected significant divergence from the medium-term budgetary objective;
(2) considérant que le pacte de stabilité et de croissance est constitué du présent règlement qui vise à renforcer la surveillance des positions budgétaires ainsi que la surveillance et la coordination des politiques économiques, du règlement (CE) n° 1467/97 du Conseil (3) visant à accélérer et clarifier la mise en oeuvre de la procédure concernant les déficits excessifs, et de la résolution du Conseil européen, du 17 juin 1997, relative au pacte de stabilité et de croissance (4) dans laquelle, conformément à l'article D du traité sur l'Union européenne, des orientations politiques fermes sont définies afin de mettre en oeuvre le pacte de stabilité et de croissance d'une manière rigoureuse et rapide et, en particulier, de respecter l'objectif à moyen terme d'une position budgétaire proche de l'équilibre ou excédentaire, auquel tous les États membres ont souscrit, et de prendre les mesures budgétaires correctrices que les États membres jugent nécessaires pour atteindre les objectifs énoncés dans leurs programmes de stabilité et de convergence dès qu'ils disposent d'informations indiquant un dérapage sensible, effectif ou prévisible, par rapport à l'objectif budgétaire à moyen terme;
