The European Council adopted last year a general orientation on the proposal for a Regulation on the Societas Cooperativa Europaea (SCE) and proposals of statutes for a European Association and a European Mutual Society are now examined by the European Parliament and the Council.

The European Council adopted a declaration on Kosovo recalling the European Union’s contribution to the implementation of United Nations Security Council Resolution 1244 on Kosovo and asking the parties to show goodwill, so as to achieve a mutually acceptable solution.

It should furthermore be noted that under Article 355(6) TFEU, the European Council may amend the status of an overseas country or territory as regards the application of the Treaties to that overseas country or territory, but the actual wording of the Treaties may only be amended by using the procedures in Article 48 TEU. The appropriateness of the European Council adopting decisions amending the wording of the Treaties can therefore be questioned, in particular taking into account Article 13(2) TFEU whereby each institution is to act within the limits of the powers conferred upon it by the Treaty.

(1a) At its meeting in Brussels on 10 and 11 December 2009 the European Council adopted a new multiannual programme called 'The Stockholm Programme – an open and secure Europe serving and protecting citizens'(hereinafter referred to as 'the Programme'). In the Programme the European Council considered that the process of abolishing all intermediate measures (the exequatur) should be continued during the period covered by the Programme.
