Notes that the examination of petitions has revealed what appear to be structural weaknesses in the implementation by Member States of various norms of Community law; is of the opinion that, in order to ensure the consistency and coherence of Community law, infringements of Community law must be consistently brought before the Court of Justice of the European Communities, at least in nationally important cases which set a precedent for national case-law and future practice; takes the view that consistency on the part of the Commission in this respect could significantly reduce citizens' subsequent need to complain to the Commission and petition Parliament on analogous issues;
15. constate que l'examen de pétitions a révélé ce qui semble bien être des faiblesses structurelles dans l'application de diverses dispositions du droit communautaire par des États membres; estime que, pour assurer l'unité et la cohérence du droit communautaire, les infractions au droit communautaire doivent être systématiquement portées devant la Cour de justice des Communautés européennes, au moins en ce qui concerne les cas importants sur le plan national qui créent un précédent pour la jurisprudence et la pratique future au niveau national; considère que la cohérence de la part de la Commission à cet égard pourrait réduire fortement le besoin que les citoyens ressentiront par la suite de se plaindre auprès de la Commission et d'adresser au Parlement des pétitions sur des sujets analogues;

I. whereas, as a result of various rulings by the Court of Justice of the European Communities, the form of PPP not involving an award procedure has been made subject to conditions, whereas increasing numbers of disputes about the award of service contracts are being brought before the Court of Justice owing to the lack of legal precision surrounding the concepts of in-house relations, public works contracts, public service contracts, and concessions in their various forms,

(2) The Charter of Fundamental Rights of the European Union reaffirms the rights as they result, in particular, from the constitutional traditions and international obligations common to the Member States, the Treaty on European Union, the Community Treaties, the European Convention for the Protection of Human Rights and Fundamental Freedoms, the social charters adopted by the Community and by the Council of Europe and the various legal instruments such as the Declaration of the Rights of the Child, and the case law of the Court of Justice of the European Communities and of the European Court of Human Rights.

NOTING that the Declaration on European Community-Canada Relations adopted by the European Community and its Member States and the Government of Canada on 22 November 1990 makes specific reference to strengthening mutual cooperation in various fields which directly affect the present and future well-being of their citizens, such as exchanges and joint projects in education and culture, including academic and youth exchanges;

Rather than continuing to favour large companies and their shareholders, we should instead be taxing them more, so that the various States or the European Community can finance a transport network for the twenty-first century.

Whereas the Commission memorandum on open and distance learning and the European Parliament's various resolutions on the subject pointed out that this form of education offers considerable new opportunities for enriching education and for economies of scale, with an increased impact especially on the promotion of a European dimension in studies at all levels; whereas the conclusions of the Council and Ministers for Education on the development of open and distance learning in the European Community (4) and on criteria for actions in open and distance learning (5) clarified the role of and criteria for Community action in this field;
