2. If, in the course of inquiries, he learns of facts which he considers might relate to criminal law, the Ombudsman shall immediately notify the competent national authorities via the Permanent Representations of the Member States to the European Communities and, insofar as the case falls within its powers, the competent Community institution, body or service in charge of combating fraud; if appropriate, the Ombudsman shall also notify the Community institution or body with authority over the official or servant concerned, which may apply the second paragraph of Article 18 of the Protocol on the Privileges and Immunities of the European Communities.

In the same way, given that the proposal for a directive lays down certain minimum common standards, it is important not to give the impression that these might prevent the Member States from implementing more favourable provisions in this area, as long as these provisions are compatible with the directive. At the same time, any more favourable standards contained in international legal instruments and agreements binding on the European Community and its Member States should also apply.

(5) In the absence of uniform rules at Community level, obstacles to cross-border services and goods or the freedom of establishment might be justified in the light of the case-law of the Court of Justice of the European Communities as long as they seek to protect recognised public interest objectives and are proportionate to those objectives; in the light of Community objectives, of the provisions, of the Treaty relating to free movement , in particular Articles 43 and 49, of secondary Community law, and in accordance with the Commission's policy on commercial communications , such obstacles can only be eliminated by establishing uniform rules at Community level and by clarifying certain legal concepts at Community level to the extent necessary for the proper functioning of the Internal Market; other restrictions have been identified as requiring replacement by less restrictive measures; remaining restrictions relating to the use and communication of sales promotions should be submitted to the principle of mutual recognition of national legislation.
(5) En l'absence de dispositions uniformes au niveau communautaire, les obstacles à la libre prestation des services transfrontaliers et à la libre circulation des marchandises ou à la liberté d'établissement peuvent être justifiés au regard de la jurisprudence de la Cour de justice des Communautés européennes , s'ils visent à protéger des objectifs d'intérêt public reconnus et leur sont proportionnés. Au regard des objectifs communautaires, des dispositions du traité relatives à la libre circulation, notamment les articles 43 et 49, et du droit communautaire dérivé et conformément à la politique de la Commission en matière de communications commerciales , ces obstacles ne peuvent être éliminés que par l'établissement de règles uniformes au niveau communautaire et par une clarification au niveau communautaire de certains concepts juridiques, dans la mesure nécessaire au bon fonctionnement du marché intérieur.

Due to its being based on Article 175(1) of the Treaty establishing the European Communities, this proposal does not apply to illegal activities involving radioactive materials, but the Commission does not rule out consideration of when it might be appropriate to make a proposal on the basis of the Treaty establishing the Atomic Energy Community (Euratom treaty).

(5) The development of information society services within the Community is hampered by a number of legal obstacles to the proper functioning of the internal market which make less attractive the exercise of the freedom of establishment and the freedom to provide services; these obstacles arise from divergences in legislation and from the legal uncertainty as to which national rules apply to such services; in the absence of coordination and adjustment of legislation in the relevant areas, obstacles might be justified in the light of the case-law of the Court of Justice of the European Communities; legal uncertainty exists with regard to the extent to which Member States may control services originating from another Member State.
(5) Le développement des services de la société de l'information dans la Communauté est limité par un certain nombre d'obstacles juridiques au bon fonctionnement du marché intérieur qui sont de nature à rendre moins attrayant l'exercice de la liberté d'établissement et de la libre prestation des services. Ces obstacles résident dans la divergence des législations ainsi que dans l'insécurité juridique des régimes nationaux applicables à ces services. En l'absence d'une coordination et d'un ajustement des législations dans les domaines concernés, des obstacles peuvent être justifiés au regard de la jurisprudence de la Cour de justice des Communautés européennes.
