IN-CONTEXT TRANSLATIONS

The provisions of this Agreement that fall within the scope of Part III, Title IV of the Treaty establishing the European Community bind the United Kingdom and Ireland as separate Contracting Parties, and not as part of the European Community, until the United Kingdom or Ireland (as the case may be) notifies the Central American Party that it has become bound as part of the European Community in accordance with the Protocol on the position of the United Kingdom and Ireland annexed to the Treaty on European Union and the Treaty establishing the European Community.

(3) This Convention shall not apply to the legislation on social security adopted by the Council, or the Council and the Parliament, of the European Community, or to legally binding provisions on social security contained in agreements between the European Community, its Member States and a third country, or adopted pursuant to such an agreement, or to any convention on social security which the United Kingdom has concluded with a third party or to any laws or regulations which amend the legislation specified in paragraph (1) for the purpose of giving effect to such a convention.

POINTS OUT that the legislation of the European Community, and the supervision thereof, as well as all other Community measures such as, for instance, programmes and recommendations, must comply with the principles of subsidiarity and proportionality, which commit all the institutions of the European Union to respect the multiplicity of economic and social traditions in the different Member States; 17. In support of these resolutions, the European Community has already taken a decision to ban driftnet fishing by Community vessels with nets in excess of 2,5 km : the EC Council of Ministers adopted, on 28 October 1991, a legally binding regulation ending driftnet fishing with nets longer than 2,5 km and providing rules for the use of nets in excess of 1 km and up to 2,5 km. The EC measure applies in all waters under the sovereignty or jurisdiction of the Member States and, outside those waters, to any vessel flying the flag of or registered in a EC Member State.
