It considered that the legal basis taken by the Council - Articles 29 et seq. of the Treaty on European Union - to impose on Member States an obligation to prescribe criminal penalties against the authors of offences against the environment was incorrect. The Commission considered that the proper legal basis was Article 175(1) of the Treaty establishing the European Community.

THE COUNCIL OF THE EUROPEAN UNION Having regard to the Treaty establishing the European Community, Considering Article 3(2) of Council Decision 90/238/Euratom, ECSC, EEC of the Council and the Representatives of the Governments of the Member States, meeting within the Council, of 17 May 1990 adopts a 1990 to 1994 action plan in the context of the "Europe against Cancer" programme, (1) Whereas a report on the evaluation of the effectiveness of action undertaken in the context of the "Europe against Cancer" programme (1987 to 1992) was submitted by the Commission on 23 March 1993, RECOGNIZES the importance of the programme, which remains entirely valid today, in particular in its role as a catalyst for, and spur to, action in the Member States to combat cancer; CONSIDERS that backing projects carried out in Member States and undertaking Community action are appropriate means of implementing the programme; UNDERLINES, however, the need to redefine and strengthen, as provided in the programme, forms of co-operation between the Commission and Member States and - as one of the means available for that purpose - to ensure improved co-ordination between the various committees under the programme with a stronger role for the Consultative Committee; INVITES the Commission to submit in due course a draft third action plan, taking into account the Council Resolution of 27 May 1993 on future action in the field of public health as well as the objectives and improvements set out in below.

No substantial prgress was made during the last session, held in mid-May 1990, because: - first, the United States and Canada are maintaining their concept of overall quotas, which is unacceptable to the European Community - 2 - - second, the developing countries are patently failing to pay sufficient attention to tightening up GATT discipline in the textiles sector, which the European Community considers vital if it is to agree to the gradual dismantling of the Multifibre Arrangement.
Lors de la dernière session de négociations de la mi-mai 1990, aucun progrès sensible n'a été réalisé parce que, - d'une part, les Etats-Unis et le Canada maintiennent leur concept de quotas globaux que la Communauté Européenne ne saurait accepter et - d'autre part, les pays en développement n'accordent visiblement pas assez d'attention au renforcement des règles et de la discipline du GATT dans le secteur textile, ce qui pour la Communauté Européenne constitue un passage obligé pour accepter le démantèlement progressif de l'Accord Multi-Fibres.

The European Community considers that more time, and additional careful GATT preparation in Geneva, will be required, in order to lay an adequate basis for the Ministerial meeting in Punta del Este in mid-September and the successful launching of a New Round of trade negotiations.
