[72] As the Council adopted instead a Framework-Decision [73] under the third pillar of the Treaty on the European Union, the Commission brought an action before the Court of Justice, in order to obtain clarifications as to whether provisions on penal sanctions belong to the first or third pillar of the Treaty on the European Union.
