Given the existing structures and operations of the Committee of European Banking Supervisors, it is important to ensure very close cooperation between the Committee of European Banking Supervisors and the Commission when establishing appropriate transitional arrangements, to ensure that the period during which the Commission is responsible for the administrative establishment and initial administrative operation of the Authority be as limited as possible.

The European Supervisory Authorities (hereinafter collectively referred to as the ‘ESAs’) should replace the Committee of European Banking Supervisors established by Commission Decision 2009/78/EC , the Committee of European Insurance and Occupational Pensions Supervisors established by Commission Decision 2009/79/EC and the Committee of European Securities Regulators established by Commission Decision 2009/77/EC , and should assume all of the tasks and competences of those committees including the continuation of ongoing work and projects, where appropriate.

In order to ensure a smooth transition of the current tasks of the Committee of European Banking Supervisors, the Committee of European Insurance and Occupational Pensions Supervisors and the Committee of European Securities Regulators to the new ESA, references to those Committees should be replaced in the relevant legislation with references to the European Supervisory Authority (European Banking Authority), the European Supervisory Authority (European Insurance and Occupational Pensions Authority) and the European Supervisory Authority (European Securities and Markets Authority), respectively.

(49) The Authority assumes all current tasks and powers of the Committee of European Banking Supervisors. Commission Decision 2009/78/EC of 23 January 2009 establishing the Committee of European Banking Supervisors should therefore be repealed, and Decision No 716/2009/EC of the European Parliament and of the Council of 16 September 2009 establishing a Community programme to support specific activities in the field of financial services, financial reporting and auditing , should be amended accordingly.

The consolidating supervisor, subject to the confidentiality requirements under Chapter 1, Section 2, shall inform the Committee of European Banking Supervisors of the activities of the college of supervisors, including in emergency situations, and communicate to that Committee all information that is of particular relevance for the purposes of supervisory convergence’.

For that purpose, Member States shall ensure that the competent authorities participate in the activities of the Committee of European Banking Supervisors and take into account its non-binding guidelines and recommendations.

The Rapporteur welcomes the proposal to establish colleges of supervisors for all cross-border banks and to require supervisors participating in those colleges to discuss and agree on specific issues with mediation mechanism via the Committee of European Banking Supervisors (CEBS).

In answer to Mr Audy, I would say that the action that he requested last year from the Committee of European Banking Supervisors (CEBS) has indeed been carried out. We have therefore questioned the CEBS, but it informed us that it itself did not have any authority in the area and that it could not even act in an advisory role.
Pour répondre à M. Audy, je dirais que la démarche qu’il avait souhaitée l’an dernier auprès du CEBS a bien été accomplie. Nous avons donc interrogé le comité des superviseurs bancaires européens mais il nous a indiqué que lui-même n’avait aucune autorité en la matière et qu’il ne pouvait même pas jouer le rôle de conseiller.
