Mr. Speaker, pursuant to Standing 34(1), I have the honour to present to this House, in both official languages, the following report of the Canadian delegation to the Organization for Security and Co-operation in Europe Parliamentary Assembly respecting its participation at the time of the 21st annual session.
Monsieur le Président, conformément au paragraphe 34(1) du Règlement, j'ai l'honneur de présenter à la Chambre, dans les deux langues officielles, le rapport de la délégation canadienne à l'Assemblée parlementaire de l'Organisation pour la sécurité et la coopération en Europe concernant sa participation à la 21 séance annuelle de l'organisme.

15. Reiterates its concern that judicial procedures have still not been sufficiently improved as regards their efficiency and rules to ensure the right to a fair and expeditious trial, including the right to access incriminating evidence and trial documents in the early phases of proceedings and sufficient guarantees for all suspects; reiterates its serious concern at the excessively long periods of pre-trial detention, which can currently go up to ten years and become de-facto punishment without a trial; urges the TGNA to reform legislation in this regard in accordance with the European Convention on Human Rights and Council of Europe standards, bringing maximum pre-trial detention periods in Turkey into line with average pre-trial detention periods in the European Union; urges the government to continue its reforms and review the Anti-Terror Law and the Turkish Penal Code; recalls that Parliament's Ad Hoc Delegation for the Observation of the Trials of Journalists in Turkey will continue to follow developments; is alarmed by the high number of juvenile prisoners – 2 500 – in the 12-18 age group;
15. réitère ses inquiétudes à l'égard du fait que les procédures judiciaires n'ont pas encore été suffisamment améliorées, sous l'angle de leur efficacité, pour garantir le droit à un procès équitable et rapide, y compris le droit d'accès aux preuves à charge et au dossier lors des premières étapes des procédures ainsi que des garanties suffisantes pour tous les suspects; réitère ses vives inquiétudes quant à la durée excessive de la détention préventive, qui peut actuellement aller jusqu'à dix ans et revient, dans les faits, à purger une peine sans procès; prie instamment la Grande Assemblée nationale de Turquie de revoir la législation en la matière pour qu'elle soit conforme à la Convention européenne des droits de l'homme et aux normes du Conseil de l'Europe, en ramenant les périodes maximales de détention préventive en Turquie aux périodes moyennes de détention préventive en vigueur dans l'Union; invite le gouvernement à poursuivre ses réformes et à revoir la loi antiterrorisme ainsi que le code pénal turc; rappelle que la délégation ad hoc du Parlement pour l'observation des procès de journalistes en Turquie continuera de suivre les développements; s'alarme du nombre élevé de détenus mineurs – 2 500 – dans la tranche d'âge 12-18;

14. Highlights the importance and potential of the EU-India strategic partnership; considers that, in the current global economic crisis, issues such as the social crisis, climate change, migration flows and global security should be addressed in a more comprehensive partnership between India and the EU; notes also that the ongoing free-trade agreement negotiations are reinforcing EU-India relations: considers, however, that this relationship should not be limited to trade issues; would welcome the re-establishment of a counterpart grouping to the European Parliament Delegation for relations with India ,following the experience of the India-Europe Friendship Group, which existed in the Indian Parliament before its 2009 elections;
14. souligne l'importance et le potentiel du partenariat stratégique UE-Inde; considère que dans le contexte de la crise économique mondiale actuelle, les questions telles que la crise sociale, le changement climatique, les flux migratoires et la sécurité mondiale doivent être abordées dans un partenariat plus large entre l'Inde et l'UE; note également que les négociations en cours sur l'accord de libre-échange renforcent les relations entre l'UE et l'Inde; estime toutefois que cette relation ne doit pas se limiter aux questions commerciales; se féliciterait de la remise sur pied d'un regroupement homologue à la délégation du Parlement européen pour les relations avec l'Inde, sur le modèle du groupe d'amitié Inde-Europe, qui existait au parlement indien avec les élections législatives de 2009;

On behalf of the British Conservative Delegation of the EPP-ED Group, I would confirm that we voted against those amendment references to the Treaty Establishing a Constitution for Europe because following the referenda outcomes in France and the Netherlands they no longer have the relevance they may have had when drafted.

4. Calls on the Russian and Chechen authorities to take into account the report presented by Lord Judd, head of a Council of Europe delegation, following his recent visit to Chechnya, and to allow the establishment in Chechnya of a permanent presence of international human right monitors from the Council of Europe and the OSCE who should be allowed to move freely, and welcomes as a first step in this direction the agreement reached between Vladimir Kalamanov, Russia's newly appointed human rights commissioner on Chechnya, and Álvaro Gil-Robles, the Council of Europe's human rights commissioner, on opening a human rights office in Chechnya, staffed by 20 workers, including two envoys from the Council of Europe;
4. invite les autorités russes et tchétchènes à tenir compte du rapport présenté par Lord Judd, chef d'une délégation du Conseil de l'Europe, au terme de sa récente visite en Tchétchénie, et à autoriser la présence permanente, en Tchétchénie, d'observateurs internationaux des droits de l'homme du Conseil de l'Europe et de l'OSCE, avec possibilité de circuler librement, et salue comme premier pas dans cette direction l'accord conclu entre M. Vladimir Kalamanov, nouveau commissaire russe aux droits de l'homme pour la Tchétchénie et M. Álvaro Gil-Robles, commissaire des droits de l'homme du Conseil de l'Europe, visant à ouvrir en Tchétchénie un bureau des droits de l'homme employant 20 personnes, dont deux délégués du Conseil de l'Europe;

Following the guidelines outlined by the international conference on education on the holocaust in Stockholm, Mr Prodi and the members of the EJC delegation examined the question of a common policy on teaching the lessons of the nazi phenomenon, the extermination of Jews in Europe and all racist or discriminatory practices.
