In the case of breach or withdrawal of undertakings by any party to the undertaking, or in the case of withdrawal of acceptance of the undertaking by the Commission, the acceptance of the undertaking shall be withdrawn by the Commission, as appropriate, and the provisional duty which has been imposed by the Commission in accordance with Article 12, or the definitive duty which has been imposed in accordance with Article 15(1), shall apply, provided that the exporter concerned, or the country of origin and/or export has, except in the case of withdrawal of the undertaking by the exporter or such country, been given an opportunity to comment.

Article 4(1) of Commission Regulation (EC) No 800/1999 of 15 April 1999 laying down common detailed rules for the application of the system of export refunds on agricultural products, as amended by Commission Regulation (EC) No 2299/2001 of 26 November 2001, read in conjunction with Article 24 of Commission Regulation (EC) No 1291/2000 of 9 June 2000 laying down common detailed rules for the application of the system of import and export licences and advance fixing certificates for agricultural products, must be interpreted as not precluding the grant of an export refund in specific circumstances such as those of the case in the main proceedings, in which the export took place without an export licence, whose existence was however established at the time the export declaration was made and which was presented, by the exporter, within the additional period of one week granted for that purpose by the competent customs office.

2. When an exporter is due to export a chemical referred to in paragraph 1 from the Union to a Party or other country for the first time on or after the date on which it becomes subject to this Regulation, the exporter shall notify the designated national authority of the Member State in which he is established (the ‘exporter’s Member State’), no later than 35 days before the expected date of export.

9. When the meat is being cleared through customs for export, the certificate of identity defined in Article 3 shall be issued, at the applicant’s request, on presentation of the export licence issued in accordance with Article 15 of Regulation (EC) No 382/2008 and a veterinary certificate showing the date of slaughter of the animals from which the meat for export derives.

By the same reasons, Council Regulation (EEC) No 565/80 of 4 March 1980 on the advance payment of export refunds in respect of agricultural products and Commission Regulations (EEC) No 2388/84 of 14 August 1984 on special detailed rules for the application of export refunds in the case of certain preserved beef and veal products , (EC) No 456/2003 of 12 March 2003 laying down special rules on the prefinancing of export refunds for certain beef and veal products placed under a customswarehousing or free zoneprocedure , (EC) No 500/2003 of 19 March 2003 on the periods for which certain cereal and rice products may remain under customs control arrangements for the advance payment of refunds and (EC) No 1994/2005 of 7 December 2005 fixing the basic products which do not qualify for advance payment of export refunds should be repealed.
Pour les mêmes raisons, il importe d'abroger le règlement (CEE) no 565/80 du Conseil du 4 mars 1980 relatif au paiement à l'avance des restitutions à l'exportation pour les produits agricoles ainsi que les règlements (CEE) no 2388/84 de la Commission du 14 août 1984 portant modalités particulières d'application des restitutions à l'exportation pour certaines conserves de viande bovine , (CE) no 456/2003 de la Commission du 12 mars 2003 établissant des conditions spécifiques en matière du préfinancement de la restitution à l'exportation pour certains produits du secteur de la viande bovine mis sous le régime douanier de l'entrepôt ou de la zone franche , (CE) no 500/2003 de la Commission du 19 mars 2003 relatif aux délais durant lesquels certains produits du secteur des céréales et certains produits du secteur du riz peuvent demeurer sous les régimes douaniers de paiement à l'avance des restitutions et (CE) no 1994/2005 de la Commission du 7 décembre 2005 portant fixation des produits de base ne bénéficiant pas du paiement à l'avance de la restitution à l'exportation

(15) Whereas ensuring compliance with constraints in terms of quantity calls for the introduction of a reliable and effective system of monitoring; whereas, to that end, the granting of refunds should be made subject to an export licence; whereas refunds should be granted up to the limits available, depending on the particular situation of each product concerned; whereas exceptions to that rule can only be permitted in the case of processed products not listed in Annex II to the Treaty, to which volume ceilings do not apply, and in the case of food-aid operations, which are exempt from any limitation; whereas provision should be made for derogations from strict compliance with management rules where exports benefiting from refunds are not likely to exceed the quantity ceilings laid down; whereas monitoring of the quantities exported with refunds during the marketing years referred to in the abovementioned international undertakings will be carried out on the basis of export licences issued for each marketing year;
(15) considérant que la surveillance des contraintes en volume requiert l'instauration d'un système de suivi fiable et efficace; que, à cet effet, il convient de soumettre l'octroi de toute restitution à l'exigence d'un certificat d'exportation; que l'octroi des restitutions dans les limites disponibles devra être effectué en fonction de la situation particulière de chacun des produits concernés; que des dérogations à cette discipline ne peuvent être admises que pour les produits transformés ne relevant pas de l'annexe II du traité auxquels des limites en valeur ne s'appliquent pas, et pour les actions d'aide alimentaire, ces dernières étant exemptes de toute limitation; qu'il est approprié d'établir la possibilité de déroger aux règles strictes de gestion, pour les produits dont les exportations avec restitutions ne sont pas susceptibles de dépasser les limites en volume; que le suivi des quantités exportées à l'aide de restitutions pendant les campagnes visées par les engagements internationaux précités sera assuré sur la base des certificats d'exportation délivrés au titre de chaque campagne;
