6. If measures financed under this Regulation are implemented on a centralised basis and indirectly by delegation to specialised Community bodies, international or national public sector bodies, or bodies governed by private law with a public service mission in accordance with Article 54(2)(c) of Regulation (EC, Euratom) No 1605/2002, participation in the public procurement and grant award procedures of the managing entity shall be open to natural persons who are nationals of the countries having access to Community contracts and grants in accordance with the principles set out in paragraph 1 of this Article, and of any other country eligible under the rules and procedures of the managing entity, and to legal persons which are established in those countries.

(9) In order to promote the free movement of workers, freedom of establishment and the free provision of services, while ensuring an adequate level of qualification, the European body recognised as competent to put forward a platform shall be, at the European level, the representative of professional bodies (or similar bodies) and/or any association recognised as representative of a professional body at European level, and shall have the task of establishing common platforms at European level under which professionals meeting a number of criteria relating to professional qualifications, based on a points system to be decided at European level, are awarded the right to bear the professional title awarded by those associations or organisations.

(5a) For the free provision of services, where the service provider moves to the territory of another Member State, provision should be made to enable the Member States to introduce a system for notification and pro forma registration with the professional association or similar body that would be competent in the territory if the professional were exercising the freedom of establishment, together with a requirement for temporary registration with the social security body of the host country, with the right to transfer contributions that have been made to the social security body of the country of establishment.

Furthermore, in the cases referred to in Article 5(1)(b), the competent bodies of the host Member State may ask the competent body of the Member State of establishment to provide proof that the service provider has practised the activities in question in the Member State of establishment for at least two years.

[24] Contracting authority within the meaning of the Public Procurement Directives are "the State, regional or local authorities, associations formed by one or more of such authorities or bodies governed by public law", where "bodies governed by public law" are defined as "any body" established for the specific purpose of meeting needs in the general interest, not having an industrial or commercial character, and having legal personality, and financed, for the most part, by the State, or regional or local authorities, or other bodies governed by public law; or subject to management supervision of those bodies; or having an administrative, managerial or supervisory board, more than half of whose members are appointed by the State, regional or local authorities or by bodies governed by public law".

Some of the core elements of this directive are the binding provisions concerning the participation of employees’ representatives, the information and consultation requirements within the administrative or supervisory bodies and the obligation to obtain authorisation before implementing decisions such as shutting down or relocating establishments, cutting back or expanding establishments, changing establishments, the establishment of subsidiaries or holding companies. Election procedures and the working methods of employees’ representatives should follow normal practice in the Member State concerned.

(g) "special negotiating body" means the body established in accordance with Article 3 to negotiate with the competent body of the participating companies regarding the establishment of arrangements for the involvement of employees within the SE;
