Whereas in and by subsection 17(1) of the Farm Products Marketing Agencies Act it is provided that the Governor in Council may by proclamation establish an agency with powers relating to any farm product or farm products the marketing of which in interprovincial and export trade is not regulated pursuant to the Canadian Wheat Board Act or the Canadian Dairy Commission Act where she is satisfied that a majority of the producers of the farm product or of each of the farm products in Canada is in favour of the establishment of an agency;

In June 2009 the Commission presented a package proposal to establish an Agency responsible for the operational management of large-scale information technology systems in the area of freedom, security and justice, consisting of a proposal for a regulation establishing the Agency and a proposal for a Council Decision conferring upon the Agency established by this regulation tasks regarding the operational management of the Second Schengen Information System (SIS II), the Visa Information System (VIS) and the European Dactylscopy (EURODAC) in application of Title VI of the EU Treaty, under the former third pillar.

The grounds for the application to establish the Agency state that it needs to be given broader authority to enable it to implement the aims of the EU, a common foreign policy included. However, expanding the authority of EU institutions is a threat to the principle of sovereignty and subsidiarity.

Is concerned about the constant increase of all types of agencies (decentralised, executive and regulatory agencies) and deplores the fact that the Commission has not been able to provide details of multi-annual programming for agencies over the next financial framework; calls on the legislative authorities to take budgetary impacts into account when establishing new agencies; emphasises, in the same context, that the increase in the working tasks of individual agencies also has massive budgetary impacts on the EU budget; calls on the Member States, in connection with the establishment of new agencies, to take the necessary responsibility for their future financing;

18. Takes the view that scrutiny of the legality of the agency's legal acts must be dealt with clearly and comprehensibly in the instrument establishing that agency, which, depending on the nature of the agency's tasks, provides that the Court of Justice is responsible for ruling on appeals made against acts of the agency under the conditions laid down in Article 230 of the EC Treaty, that administrative complaints against the agency's acts may be brought before the Commission and that an appeal for annulment might then be brought against the Commission's decision before the Court of Justice. Alternatively, the instrument establishing the agency may stipulate that the agency's acts are, firstly, subject to an internal appeal before independent boards of appeal and that their decisions may then be submitted to the Court's consideration;

Notes that the amount given over to the agencies in the PDB for 2004 is EUR 212 million, under heading 3, as a result of the significant increase for the newly created agencies following adoption of their respective legal bases, the establishment of two new agencies and, lastly, what is required by all of them for enlargement; believes that, particularly given the increasing trend towards decentralisation of EU activities, the rigour imposed on the institutions should, similarly, apply to the agencies; points out that, according to the joint statement agreed in the context of the revision of the regulations establishing the agencies, the competent bodies should endeavour to settle the question of the agencies' final locations as early as possible;
