Transitional measures should be laid down to enable the Czech Republic, Estonia, Cyprus, Latvia, Lithuania, Hungary, Malta, Poland, Slovenia and Slovakia (hereinafter the new Member States) to apply the levy scheme provided for in Council Regulation (EC) No 1788/2003 of 29 September 2003 establishing a levy in the milk and milk products sector (1).

3. Individual reference quantities which have been the subject of temporary transfers in accordance with Article 6 of Council Regulation (EEC) No 3950/92 of 28 December 1992 establishing an additional levy in the milk and milk products sector(32) or Article 16 of Council Regulation (EC) No 1788/2003 of 29 September 2003 establishing a levy in the milk and milk products sector(33) on 31 March of the calendar year concerned shall be deemed to be available on the holding of the transferee for that calendar year.
3. Les quantités de référence individuelles ayant fait l'objet de cessions temporaires conformément à l'article 6 du règlement (CEE) n° 3950/92 du Conseil du 28 décembre 1992 établissant un prélèvement supplémentaire dans le secteur du lait et des produits laitiers(32) ou à l'article 16 du règlement (CE) n° 1788/2003 du Conseil du 29 septembre 2003 établissant un prélèvement dans le secteur du lait et des produits laitiers(33) au 31 mars de l'année civile concernée sont considérées comme étant à la disposition de l'exploitation du cessionnaire pour ladite année civile.
