In that regard, it should be emphasised that the case-law on which the applicant relies, under the terms of which it was held that the institution was not entitled to substitute an entirely new statement of reasons for the initial, erroneous, statement (Berlingieri Vinzek v Commission, cited above, paragraph 79), relates to the specific situation in which the institution provides supplementary reasons after the appeal has been brought and is not therefore applicable to the pre-litigation stage.

Thus, further information could have been provided during the proceedings, depriving of its purpose the ground of appeal alleging the absence of a statement of reasons, bearing in mind, however, that the Commission was not entitled to substitute an entirely new statement of reasons for the initial, erroneous, statement (see, to that effect, Berlingieri Vinzek v Commission, paragraph 23 above, paragraph 79, and Case T‑277/02 Pascall v Council [2004] ECR-SC I‑A‑137 and II‑621, paragraph 31).

As the third ground for annulment, the applicant maintains that the contested decision is vitiated by an error in the assessment of the facts and contravenes an essential procedural requirement, because the Commission, by means of an erroneous assessment of the facts and with a defective and/or insufficient statement of reasons, came to the conclusion that the measures of interest rate subsidy and provision of a guarantee by the government for the funding to the Association of Agricultural Co-operatives constitute unlawful State aid, since they constitute a selective economic advantage for direct and indirect beneficiaries and threaten to distort competition and to affect trade between Member States.

Notes with concern that, despite its high cost, the audit-certificate system has in 2005 not yet provided the hoped-for guarantees, since the Court has detected erroneous statements relating to staff costs and general expenditure, in respect of which 'clean' audit certificates have been issued; notes however that the quality of the audit certificate has improved after the requirements for these certificates were published; invites the Commission to further develop suitable criteria for audit certificates in order to improve their usefulness;
