1. Article 22 of Council Regulation (EC) No 1260/1999 laying down general provisions on the Structural Funds (OJ L 161, 26 June 1999) states that, in accordance with Article 4 of Regulation (EC) No 1783/1999 on the ERDF (OJ L 213, 13 August 1999), "At the initiative of the Commission.the Funds may finance innovative actions.[which] contribute to the preparation of innovative methods and practices designed to improve the quality of assistance under Objectives 1, 2 and 3.

In the context of transnational cooperation and in duly justified cases, the ERDF may finance expenditure incurred by partners located outside the area participating in operations up to a limit of 20 % of the amount of its contribution to the operational programme concerned, where such expenditure is for the benefit of the regions in the cooperation objective area.

In the context of cross-border cooperation and in duly justified cases, the ERDF may finance expenditure incurred in implementing operations or parts of operations up to a limit of 20 % of the amount of its contribution to the operational programme concerned in NUTS level 3 areas adjacent to the eligible areas for the programme referred to in Article 7(1) of Regulation (EC) No 1083/2006 or surrounded by such adjacent areas.

In the context of cross-border, transnational and interregional cooperation, the ERDF may finance expenditure incurred in implementing operations or parts of operations on the territory of countries outside the European Community up to a limit of 10 % of the amount of its contribution to the operational programme concerned, where they are for the benefit of the regions of the Community.

Dans le cadre de la coopération transfrontalière, transnationale et interrégionale, le FEDER peut financer, jusqu'à concurrence de 10 % du montant de sa contribution au programme opérationnel concerné, des dépenses encourues pour la mise en œuvre d'opérations ou de parties d'opérations sur le territoire de pays situés en dehors de la Communauté européenne, à condition qu'elles bénéficient aux régions de la Communauté.

(2) Article 2 of Regulation (EC) No 1783/1999 of the European Parliament and of the Council of 12 July 1999 on the European Regional Development Fund(3) specifies the type of operations the ERDF may help finance.

The ERDF may finance, up to a limit of 0,5 % of its annual allocation, the preparatory, accompanying and assessment measures necessary for the implementation of this Regulation carried out by the Commission or by outside experts.
