Any suspect or accused person in respect of whom the EPPO initiates an investigation should benefit from those rights, as well as from the rights provided for in national law to request that experts are appointed or that witnesses are heard, or that evidence on behalf of the defence is otherwise produced by the EPPO.

2. When a judicial or law enforcement authority of a Member State initiates an investigation in respect of a criminal offence for which the EPPO could exercise its competence in accordance with Article 22, Article 25(2) and (3), or where, at any time after the initiation of an investigation, it appears to the competent judicial or law enforcement authority of a Member State that an investigation concerns such an offence, that authority shall without undue delay inform the EPPO so that the latter can decide whether to exercise its right of evocation in accordance with Article 27.

Lorsqu’une autorité judiciaire ou répressive d’un État membre ouvre une enquête concernant une infraction pénale à l’égard de laquelle le Parquet européen pourrait exercer sa compétence conformément à l’article 22 et à l’article 25, paragraphes 2 et 3, ou si, à un moment quelconque après l’ouverture d’une enquête, l’autorité judiciaire ou l’autorité répressive compétente d’un État membre constate que l’enquête concerne une telle infraction, cette autorité en informe le Parquet européen sans retard indu afin que ce dernier puisse décider d’exercer ou non son droit d’évocation conformément à l’article 27.

In order to ensure legal certainty and to effectively combat offences affecting the Union’s financial interests, the investigation and prosecution activities of the EPPO should be guided by the legality principle, whereby the EPPO applies strictly the rules laid down in this Regulation relating in particular to competence and its exercise, the initiation of investigations, the termination of investigations, the referral of a case, the dismissal of the case and simplified prosecution procedures.
Afin de garantir la sécurité juridique et de lutter efficacement contre les infractions portant atteinte aux intérêts financiers de l’Union, les activités d’enquête et de poursuite du Parquet européen devraient être guidées par le principe de légalité, en vertu duquel le Parquet européen applique strictement les règles définies dans le présent règlement en ce qui concerne en particulier la compétence et son exercice, l’ouverture des enquêtes, la clôture des enquêtes, le renvoi d’une affaire, le classement sans suite d’une affaire et les procédures simplifiées en matière de poursuites.

3. When a judicial or law enforcement authority of a Member State initiates an investigation in respect of a criminal offence as defined in Article 22 and considers that the EPPO could, in accordance with Article 25(3), not exercise its competence, it shall inform the EPPO thereof.

When a judicial or law enforcement authority of a Member State initiates an investigation in respect of a criminal offence and considers that the EPPO could not exercise its competence, it should inform the EPPO thereof, in order to allow the latter to assess whether it should exercise competence.
Lorsqu’une autorité judiciaire ou répressive d’un État membre ouvre une enquête concernant une infraction pénale et estime que le Parquet européen pourrait ne pas exercer sa compétence, elle devrait en informer le Parquet européen, afin de permettre à celui-ci d’apprécier s’il devrait exercer sa compétence.

12. Believes that rules governing the division of jurisdiction between the EPPO and the national authorities should be clearly defined in order to avoid any uncertainty or misinterpretation in the operational phase: the EPPO should have jurisdiction to investigate and prosecute the offences constituting fraud to the Union’s financial interests according to the directive on the fight against fraud to the Union’s financial interests by means of criminal law; believes that the EPPO should first decide whether it has competence and before national authorities initiate their own investigations, in order to avoid parallel investigations which are inefficient;

the setting up of a decentralised structure – as proposed by the Commission – that enables the European Delegated Prosecutors to initiate and lead investigations in their or in another Member State, allowing for investigations to remain within national prosecution systems, while at the same time the EPPO being informed by the Prosecutor whenever an investigation is launched; thereby preventing the problems currently being experienced by OLAF, which has to rely on Member States’ authorities to provide a certain level of information for being able to fulfil its function;
