For the enforcement of the obligations under Directive 96/71/EC, in particular Article 6 thereof, and this Directive, Member States shall ensure that there are effective mechanisms for posted workers to lodge complaints against their employers directly, as well as the right to institute judicial or administrative proceedings, also in the Member State in whose territory the workers are or were posted, where such workers consider they have sustained loss or damage as a result of a failure to apply the applicable rules, even after the relationship in which the failure is alleged to have occurred has ended.

Aux fins de l'exécution des obligations établies par la directive 96/71/CE, et notamment son article 6, et par la présente directive, les États membres veillent à disposer de mécanismes efficaces permettant à un travailleur détaché de porter plainte directement contre son employeur et d'engager une procédure judiciaire ou administrative, également dans l'État membre sur le territoire duquel le travailleur est ou a été détaché, lorsque ce dernier considère avoir subi une perte ou un préjudice du fait du non-respect des règles applicables, et ceci même après le terme de la relation dans le cadre de laquelle le manquement est censé avoir eu lieu.
