1. The Staff Regulations of Officials of the European Union (‘Staff Regulations’) and the Conditions of Employment of Other Servants of the Union (‘Conditions of Employment’), laid down in Council Regulation (EEC, Euratom, ECSC) No 259/68 , and the rules adopted in agreement between the institutions of the Union for giving effect to those Staff Regulations and the Conditions of Employment shall apply to the Agency's staff.

In order to ensure open and transparent employment conditions and equal treatment of staff, the Staff Regulations of Officials of the European Union (Staff Regulations of Officials) and the Conditions of Employment of Other Servants of the European Union (Conditions of Employment), laid down in Regulation (EEC, Euratom, ECSC) No 259/68 (together referred to as the ‘Staff Regulations’), should apply to the staff and to the Executive Director of the Agency, including the rules of professional secrecy or other equivalent duties of confidentiality.
Afin de garantir des conditions d’emploi ouvertes et transparentes et l’égalité de traitement du personnel, le statut des fonctionnaires de l’Union européenne (ci-après dénommé «statut des fonctionnaires») et le régime applicable aux autres agents de l’Union (ci-après dénommé «régime»), fixés par le règlement (CEE, Euratom, CECA) no 259/68 du Conseil (ci-après dénommés conjointement «statut») devraient s’appliquer au personnel et au directeur exécutif de l’agence, y compris les règles relatives au secret professionnel ou à toute autre obligation de confidentialité équivalente.

The Staff Regulations of Officials of the European Union ("Staff Regulations of Officials") and the Conditions of Employment of Other Servants of the European Union ("the Conditions of Employment") laid down in Council Regulation (EEC, Euratom, ECSC) 259/68 ("the Staff Regulations"), and the rules adopted jointly by the Union institutions for the purpose of applying these Staff Regulations shall apply to the staff of the Agency, and to the Executive Director.

(11a) Directive 96/71/EC lays down minimum rules for the protection of workers applicable to posted workers on the territory of a Member State other than the State in which they normally work and does not prevent Member States from imposing other terms and conditions of employment laid down in collective agreements, nor from imposing other employment conditions where these are public policy provisions.
(11 bis) La directive 96/71/CE définit des règles minimales pour la protection des travailleurs applicables aux travailleurs détachés sur le territoire d'un État membre autre que l'État dans lequel il travaille habituellement et n'empêche pas les États membres d'imposer d'autres conditions de travail et d'emploi fixés dans des conventions collectives ni d'imposer d'autres conditions de travail et d'emploi dès lors qu'il s'agit de dispositions d'ordre public.

2. The conditions as to length of residence and employment laid down in point (a) of paragraph 1 and the condition as to length of residence laid down in point (b) of paragraph 1 shall not apply if the worker's or the self-employed person's spouse or partner as referred to in point 2(b) of Article 2 is a national of the host Member State or has lost the nationality of that Member State by marriage to that worker or self-employed person.
2. Les conditions de durée de séjour et d'activité prévues au paragraphe 1, point a), et la condition de durée de résidence prévue au paragraphe 1, point b), ne s'appliquent pas si le conjoint ou le partenaire, tel que visé à l'article 2, point 2 b), du travailleur salarié ou non salarié est ressortissant de l'État membre d'accueil ou s'il a perdu la nationalité de cet État membre à la suite de son mariage avec le travailleur salarié ou non.

The conditions as to length of residence and employment laid down in paragraph 1(a) and the condition as to length of residence laid down in paragraph 1(b) shall not apply if the worker's spouse, registered partner or unmarried partner is a national of the Member State concerned or has lost the nationality of that State by marriage to that worker.
2. (2) The conditions as to length of residence and employment laid down in paragraph 1(a) and the condition as to length of residence laid down in paragraph 1(b) shall not apply if the worker’s spouse is a national of the Member State concerned or has lost the nationality of that State by marriage to that worker.

(2) The conditions as to length of residence and employment laid down in paragraph 1(a) and the condition as to length of residence laid down in paragraph 1(b) shall not apply if the worker’s spouse or partner, within the meaning of Article 2(2) (a),(aa) or (b) is a national of the Member State concerned or has lost the nationality of that State by marriage to that worker.
2.
