Pursuant to its Article 1(3)(c), the Directive on the posting of workers notably applies to a temporary employment undertaking or placement agency which hires out a worker to a user undertaking established or operating in the territory of a Member State, provided there is an employment relationship between the temporary employment undertaking or placement agency and the worker during the period of posting.

In accordance with Article 3(1) of the same Directive, with respect to posted workers, certain terms and conditions of employment, which include ‘the minimum rates of pay, including overtime rates’ and ‘the conditions of hiring-out of workers, in particular the supply of workers by temporary employment undertakings’, have to be respected to the extent that they are set by law or universally applicable collective agreements.

THE LOOPHOLE OF THE ACTUAL DIRECTIVE The 1975 Directive requires employers who are contemplating redundancies to inform and consult workers' representatives with a view to reaching an agreement and to notify the competent public authority. However, it does not make specific provision for situations in which redundancies among an employing undertaking's employees are proposed by its controlling undertaking whether the controlling undertaking is situated in the same Member State as the controlled undertaking (the employer) or in a different State.

However, it cannot be assumed that "all relevant information" held by a controlling undertaking concerning the proposed redundancies will always be provided to the employing undertaking for the purposes of consulting worker representatives.
