(5) Where an employer has failed to deliver a record of employment to an insured person or to the Commission or the employer is not available or is unable to provide information respecting the record of hours of insurable employment and the insurable earnings of that person because the employer's records are destroyed or lost, the person, on becoming a claimant, may provide, in respect of their hours of insurable employment and insurable earnings, a statement containing evidence of the hours and earnings.

6 (1) Where a person is employed in insurable employment by an employer for services in or in connection with lumbering or logging, in any logging limit or in any timber or lumber driveway, mill or yard, the owner of that limit, driveway, mill or yard who authorizes the employer to undertake the work shall, in the event of the default of the employer in calculating the insurable earnings of the person and in paying, deducting and remitting the premiums payable on those insurable earnings under the Act and these Regulations, be deemed to be the employer of the person for the purposes of maintaining records, calculating the person’s insurable earnings and paying, deducting and remitting those premiums.
6 (1) Lorsqu’une personne exerce un emploi assurable dans le cadre duquel elle fournit à l’employeur des services se rattachant directement ou indirectement à des activités de débit et d’exploitation du bois dans une coupe, une voie de charriage, un moulin ou un chantier et que le propriétaire de ce lieu a autorisé l’employeur à entreprendre le travail, ce propriétaire est réputé, en cas de défaut de la part de l’employeur de calculer la rémunération assurable de la personne et de payer, de retenir et de verser les cotisations exigibles à cet égard aux termes de la Loi et du présent règlement, être l’employeur de la personne aux fins de la tenue des registres, du calcul de la rémunération assurable et du paiement, de la retenue et du versement des cotisations ainsi exigibles.

16 (1) Where records, books of account, accounts or vouchers of an employer are not kept as required by section 87 of the Act, or any document related thereto is not kept, an officer of the Department of National Revenue shall determine in accordance with the Act and these Regulations the amount of insurable earnings and premiums payable on those insurable earnings in respect of each insured person who is employed in insurable employment by the employer.
16 (1) Lorsque les registres, livres comptables, comptes ou pièces justificatives d’un employeur ne sont pas tenus conformément à l’article 87 de la Loi, ou que les documents s’y rapportant ne sont pas conservés, le montant de la rémunération assurable et des cotisations exigibles à cet égard pour chaque assuré exerçant un emploi assurable au service de l’employeur est déterminé par un fonctionnaire du ministère du Revenu national conformément à la Loi et au présent règlement.

24 (1) Where records, books of account, vouchers or accounts of an employer are not kept in accordance with section 58 of the Act, or any document related thereto is not kept, an officer of the Department of National Revenue shall determine in accordance with the Act and these Regulations the amount of insurable earnings and the premiums payable thereon in respect of each insured person who is employed in insurable employment by the employer.

87 (1) An employer paying remuneration to a person they employ in insurable employment shall keep records and books of account at the employer’s place of business or residence in Canada, or at such other place as may be designated by the Minister, in such form and containing such information, including the Social Insurance Number of each insured person, as will enable the determination of any premiums payable under this Act or any premiums or other amounts that should have been deducted or paid.
