The Agency shall, based on matters of fact, provide a duly reasoned opinion as well as recommendations to the ENTSO for Electricity, the ENTSO for Gas, the European Parliament, the Council and the Commission, where it considers that the draft annual work programme or the draft non-binding 10-year network development plan submitted to it in accordance with the second subparagraph of Article 9(2) of Regulation (EC) No ./2009 [on conditions for access to the network for cross-border exchanges in electricity] and the second subparagraph of Article 9(2) of Regulation (EC) No ./2009 [on conditions for access to the natural gas transmission networks] do not contribute to non-discrimination, effective competition and the efficient functioning of the market or a sufficient level of cross-border interconnection open to third-party access, or are not in compliance with the relevant provisions of Regulation (EC) No ./2009 [on conditions for access to the network for cross-border exchanges in electricity] and Regulation (EC) No ./2009 [on conditions for access to the natural gas transmission networks] or Directive 2009/./EC [concerning common rules for the internal market in electricity] and Directive 2009/./EC [concerning common rules for the internal market in natural gas].
4. Barriers to cross-border supply of gas and electricity (lack of cross-border capacity, long-term capacity reservations, lack of investment in additional capacity, lack of regulation for cross-border issues) stand in the way of development of an integrated energy market.

The purpose of the Regulation is to stimulate cross-border exchanges in electricity by establishing a compensation mechanism for transit flows of electricity and by introducing harmonised principles on cross-border transmission charges and the allocation of available interconnection capacities between national transmission systems.

We reject Amendments Nos 14, 42, 43 and 44 and Amendment No 58, which seeks to achieve cross-border trading in electricity certificates. That is premature at this stage and cannot be accepted at the moment.

It is no longer being continued: instead, cooperation in the relevant regions will in future be pursued under the Interreg II C programme. It has also been possible for cross-border projects to receive funding under Article 10 of the ERDF (ECU 200 m), in cases where projects were simultaneously both of a cross-border and of an inter-regional nature. Such programmes include Recite (cooperation between EU internal regions), Ecos/Ouverture (inter-regional cooperation with countries external to the EU), Urban pilot projects and Terra (urban planning and development of networks of regional and local authorities).
Parmi ces programmes figurent entre autres Recite (coopération interrégionale à l'intérieur de l'Union européenne), ECOS/Ouverture (coopération interrégionale avec des pays tiers), projets pilotes URBAN et TERRA (aménagement urbain et développement de réseaux des autorités régionales et locales). La création de réseaux de coopération entre villes est soutenue par l'initiative URBAN (600 millions d'écus).
