29. Where it appears to the Bank that a bond and unmatured coupons attached to it, if any, cancelled by a bank incorporated under the Bank Act or the Quebec Savings Banks Act have been destroyed, lost or stolen while in the custody of the bank or in the course of transit from a branch of the bank to its main office or to any agency of the Bank, if the bank certifies that the bond and each coupon attached thereto was effectively cancelled for purposes and in accordance with arrangements expressly approved by the Bank and gives to the Bank an undertaking to indemnify in accordance with section 37 duly executed on its behalf at its head office and three months have elapsed after the day on which the Bank received notice of the destruction, loss or theft, the Bank may, in its discretion, issue a new bond and appropriate coupons in place of them.
29. Lorsqu’il paraît à la Banque qu’une obligation et des coupons joints non échus, s’il en est, qui ont été annulés par une banque constituée en vertu de la Loi sur les banques ou la Loi sur les banques d’épargne de Québec ont été détruits, perdus ou volés pendant qu’ils étaient confiés à la garde de la banque ou durant le parcours entre une succursale de cette banque, son bureau principal ou une agence de la Banque, si cette banque certifie que l’obligation et chaque coupon qui y était joint avaient été effectivement annulés à des fins et suivant des dispositions expressément approuvées par la Banque et fournit à celle-ci un engagement d’indemniser, suivant l’article 37, dûment souscrit de sa part à son bureau principal, et s’il s’est écoulé trois mois depuis la date où la Banque a reçu l’avis de destruction, perte ou vol, la Banque peut, si elle le juge à propos, les remplacer par une nouvelle obligation et les coupons afférents.
