Deplores the European Civil Service Tribunal judgment published on 22 May 2014 condemning the EESC for breaching the Charter of Fundamental Rights of the European Union when dismissing one of its staff members in 2013; also deplores the ruling handed down on 8 October 2014 in Case T-530/12 P, M. B. G. v EESC, in which the General Court found against the EESC in connection with the reporting of irregularities concerning the former Secretary-General by the head of the EESC Legal Service; calls on the EESC and its new Secretary-General to take the steps required to prevent further serious breaches of the Charter of Fundamental Rights of the European Union, to inform the EESC Bureau, the members, and the entire staff about the content of the two judgments, and to draw their attention to the fact that officials and other staff covered by the Staff Regulations have an obligation to report irregularities and that the EESC Bureau is an appropriate body to receive such reports; also asks to be informed about the total legal expenses incurred in the last five years in staff cases ultimately dealt with in the courts or by the Ombudsman;

3.2 Concerning the legal basis, the EESC considers that beyond the mere completion of the internal market, what is also at stake here is an instrument to protect consumers, and the most appropriate legal basis, if Article 81 of the TFEU is not adopted, would therefore be Articles 169(2)(b) and (4) of the Treaty and not just Article 114, as well as Articles 38 and 47 of the Charter of Fundamental Rights of the European Union.
3.2 Pour ce qui est de la base juridique, le CESE est d'avis que par-delà le simple achèvement du marché intérieur, l'enjeu dont il s'agit ici est la création d'un instrument de protection des consommateurs, raison pour laquelle la base juridique la plus indiquée, si l'article 81 n'était pas adopté, serait l'article 169, paragraphe 2, alinéa b et paragraphe 4 du TFUE, et pas seulement l'article 114, ainsi que les articles 38 et 47 de la Charte des droits fondamentaux de l'UE.

1.1 The EESC, which has been calling for an initiative of this nature for a long time, welcomes the Commission's proposal and supports its choice of a regulation as the legal instrument.

Points out that some of the reductions introduced by the Council would jeopardize the EESC's core functions and call into question its ability to meet its legal obligations towards its staff; decides therefore to restore the DB for appropriations available to EESC Members to carry out the institution's core activity of enabling civil society organisations from the Member States to express their views at European level, which at the level of prudent estimates for inflation effectively means a freeze in real terms, to partly restore the DB for staff remuneration and allowances to enable the EESC to meet its obligations towards its staff and to partly restore the DB for interpretation to bring the level back to execution in 2009, which would still, given increased rates for interpretation, mean a decrease in real terms;

Regardless of the legal basis for consultation (mandatory or optional referral) EESC opinions are a legally necessary component in the final document of the Council, the Commission or the Parliament.

The EESC therefore recommends that the European Commission look for flexible financial, technical and legal instruments to encourage Member States to seek to integrate the various existing solutions into one interoperable system.
Par conséquent, le CESE recommande à la Commission européenne de rechercher des instruments financiers, techniques et juridiques flexibles afin d’encourager les États membres à intégrer les différentes solutions existantes dans un système interopérable.
