In fact, Mr President, it can be deduced from the Khalil judgement that the Court has not criticised the inclusion of stateless persons and refugees in Regulation (EEC) No 1408/71, based on Article 51 – currently Article 42 – of the EC Treaty, solely insofar as it involves a small category of people, in relation to which the Member States have made international commitments.
En effet, Monsieur le Président, il ressort de l'arrêt Khalil que la Cour n'a pas censuré l'inclusion des apatrides et des réfugiés dans le règlement (CEE) n° 1408/71, basé sur l'article 51, actuellement l'article 42, du traité CE, uniquement dans la mesure où il s'agit d'une catégorie restreinte de personnes, à l'égard de laquelle les États membres ont pris des engagements internationaux.

11. Welcomes the Commission's plan to launch a Europe-wide campaign on equal pay in 2002 and urges the Commission to bring forward, in conjunction with this campaign, a proposal for revision and updating of Directive 75/117/EEC , paying sufficient attention to the issue of job classification and inserting a number of rules and criteria in an annex in order to ensure an objective gender-neutral evaluation system in accordance with a standard form as a means of narrowing the gender pay gap; asks the Commission in this connection to take account of the need for consistency with the provisions of the directives based on Article 13 of the Treaty, (Directives 2000/43/EC and 2000/78/EC) and of the draft amending Directive 76/207/EEC ; urges the Commission to consider also what other type of measures or schemes might be introduced and by what methods for this purpose, including encouragement of the involvement of the social partners;
11. se félicite du projet de la Commission de lancer une campagne européenne sur l'égalité de rémunération en 2002 et invite instamment la Commission à présenter, dans le contexte de cette campagne, une proposition ayant pour objectif la révision et l'actualisation de la directive 75/117/CEE , en accordant une attention suffisante au problème de la classification professionnelle et en prévoyant l'insertion, dans une annexe, d'un certain nombre de règles et de critères qui garantissent l'application, sous une forme normalisée, d'un système d'évaluation objectif et non sexiste, ce dans la perspective d'une réduction de l'écart de rémunération entre les sexes; invite la Commission à tenir compte à cet égard de la nécessaire cohérence avec les dispositions des directives fondées sur l'article 13 du traité (directives 2000/43/CE et 2000/78/CE) et celles de la proposition modifiant la directive 76/207/CEE ; invite instamment la Commission à envisager d'autres types de mesures ou d'autres schémas ainsi que les méthodes à mettre en œuvre, y compris l'encouragement de la participation des partenaires sociaux;

All awards involving investment of ECU 4 500 000 or more or grants at a nominal intensity of 15 % or above shall be notified in advance to the Commision under Article 93 (3) of the EEC Treaty.

In 1991 the Commission closed the files on 835 individual cases under Articles 85 and 86 of the EEC Treaty involving restrictive agreements and abuses of dominant positions. A total of 146 proceedings were terminated by the sending of comfort letters, preceded in five cases by publication of a notice inviting comments from interested parties; a further 676 cases were settled because they were of minor importance or had ceased to pose a problem, or because investigation had not revealed any anti-competitive practices.
Au cours de l'année écoulée, la Commission a pu clôturer 835 dossiers portant sur des cas individuels relatifs aux articles 85 et 86 du traité CEE sur les accords et abus de positions dominantes; 146 dossiers l'ont été par une lettre administrative de compatibilité, précédée dans cinq cas par la publication d'une communication à l'attention des tiers intéressés; 676 affaires ont été classées, soit qu'elles étaient d'importance mineure, soit qu'elles étaient devenues sans objet, ou enfin que les vérifications n'avaient pas révélé de pratiques anticoncurrentielles.

The new range of proposed actions calls for a set of new more flexible and better adapted procedures some of which are already identified: - Joint Undertakings, extending to the EEC Treaty the system laid down under the Euratom Treaty (ex. JET); - supplementary programmes, extending to the EEC Treaty an instrument already existing under the Euratom Treaty and effectively enabling variable geometry participation; - supported concerted action involving support from the Community budget amounting to 10-20% of the costs of the action; - integrated actions covering all of the activities developed in a given research sector by the Member States; - minority participation by the Community in national and multinational actions or projects; - innovation loans (ex. NIC IV); - certain facilities emanating from new Commission initiatives in financial engineering.
La nouvelle gamme d'actions proposees exige la mise en oeuvre de methodes nouvelles, a la fois plus flexibles et mieux adaptees, dont certaines ont deja ete identifiees : - les entreprises communes, constituant une extension au traite CEE du systeme prevu dans le traite Euratom (JET, par exemple); - les programmes complementaires, etendant au traite CEE un instrument existant dans le cadre du traite Euratom et permettant une utilisation efficace de la participation a geometrie variable; - l'action concertee renforcee qui impliquera une intervention du budget communautaire au niveau de 10 a 20% du cout de l'action; - les actions integrees couvrant l'ensemble des activites developpees par les Etats membres dans un secteur de recherche donne. - 5 - - Les participations minoritaires de la Communaute a des actions ou des projets nationaux et multinationaux; - les prets a l'innovation (NIC IV, notamment); - certains instruments emanant de nouvelles initiatives de la Commission en matiere d'ingenierie financiere.

Without prejudice to the provisions of Council Regulation (EEC) No 1192/69 of 26 June 1969 on common rules for the normalisation of the accounts of railway undertakings, and of Council Regulation (EEC) No 1191/69 of 26 June 1969 on action by Member States concerning the obligations inherent in the concept of a public service in transport by rail, road and inland waterway, Member States shall neither take co-ordination measures nor impose obligations inherent in the concept of a public service which involve the granting of aids pursuant to Article 77 of the Treaty except in the following cases or circumstances: 1. As regards co-ordination of transport: (a) where aids granted to railway undertakings not covered by Regulation (EEC) No 1192/69 are intended as compensation for additional financial burdens which those undertakings bear by comparison with other transport undertakings and which fall under one of the heads of normalisation listed in that Regulation;
Sans préjudice des dispositions du règlement (CEE) nº 1192/69 du Conseil, du 26 juin 1969, relatif aux règles communes pour la normalisation des comptes des entreprises de chemin de fer et du règlement (CEE) nº 1191/69 du Conseil, du 26 juin 1969, relatif à l'action des États membres en matière d'obligations inhérentes à la notion de service public dans le domaine des transports par chemin de fer, par route et par voie navigable, les États membres ne prennent de mesures de coordination ni n'imposent de servitudes inhérentes à la notion de service public comportant l'octroi d'aides au titre de l'article 77 du traité que dans les cas et conditions suivants: 1. en matière de coordination des transports: a) lorsque les aides accordées aux entreprises de chemin de fer qui ne sont pas soumises au règlement (CEE) nº 1192/69 sont destinées à compenser le supplément de charges qu'elles supportent par rapport à d'autres entreprises de transport au titre d'un des postes de normalisation retenus dans ce même règlement;
