The delegation of the EFTA States participating in the EEA was headed by Mr ASGRIMSSON, Minister for Foreign Affairs of Iceland. 2. The EEA Council noted the progress report presented by the Chairman of the EEA Joint Committee. 3. The EEA Council assessed the overall functioning and development to date of the EEA Agreement and: - noted the continued progress of the Joint Committee in incorporating relevant Community legislation into the EEA Agreement and the need for continued support of its work if the objective of complete alignment of EEA and Community legislation were to be fully achieved; - recognized the crucial role of uniform implementation of legislation for the success of the internal market extended to the EEA and welcomed the good progress in integrating EEA legislation in Liechtenstein following its full participation from 1 May 1995; - noted that the provisions of the Agreement for development of cooperation had led to inclusion of new areas in the fields of both programmes and legislation; with regard to committees managing programmes in which the EFTA/EEA countries participate under Articles 81 and 82 of the Agreement, the EEA Council underlined the need to ensure the participation of the EFTA/EEA countries as soon as EFTA commitment has been assured; - welcomed the continuing participation of the EFTA States, through the consultation and information procedures, in the shaping of EEA-relevant legislation in preparation in the EU and noted the EFTA/EEA States' interest in participating in certain committees of similar characteristics to those listed in Protocol 37; - welcomed the resumption of formal meetings of the EEA Consultative Committee and the continued close contacts and cooperation at informal level; - noted the continuing difference of view between the EU and its EFTA partners on the EU's use of Articles 112 and 113 of the EEA Agreement in relation to fish.

Concerning developments relating directly to the good functioning of the EEA Agreement, the EEA Council: - took note of the interim report for 1995 presented by the Joint Committee and commended the Joint Committee on its work; - expressed its satisfaction at the overall functioning of the Agreement and noted that the EFTA countries, taking part in the EEA, are effectively involved in the evolution of the internal market; - reaffirmed its commitment to the decision-shaping and decision-making procedures provided for in the EEA Agreement; in this context, it underlined the continuing need for the effective functioning of the information and consultation process during the development by the EU of new legislation relevant to the EEA Agreement and for the integration of new Community legislation into the EEA Agreement without delay after its adoption by the Community; - underlined the dynamic character of the Agreement and noted its provisions aimed at further development of the cooperation; - agreed that the provisions of the Agreement concerning cooperation at ministerial level should be fully used in order to allow the EEA Council to fulfil effectively its role which consists in giving the political impetus in the implementation of the Agreement and laying down the general guidelines for the EEA Joint Committee. 5. The EEA Council: - welcomed the progress made along the lines of the pragmatic strategy endorsed by the EEA Council at its meeting in May 1995 for introducing diagonal cumulation between the EC/EFTA countries, treated as one territory for the purposes of rules of origin, and the associated CEECs and underlined the importance of the timely implementation of the strategy defined by the European Council meeting in Essen towards a European cumulation; - stressing the importance of finalising Protocol 3 with a view to improving market access for processed agricultural products in trade between the EU and its EFTA partners, urged the EEA Joint Committee to complete this part of the EEA Agreement, recognizing the need to find arrangements which comply with the Uruguay Round settlement; - noted the positive developments in discussions on closer co-operation in the veterinary field; - noted the resumption of the discussions on the incorporation of the Regulation on maritime cabotage into the EEA Agreement. 6. As regards maintenance of homogeneity in the EEA, which entails the uniform application of common legislation across the European Economic Area, the EEA Council: - noted that the Council of the European Union had recently established a Code of Conduct with regard to declarations made in the Council, emphasising a more open and transparent practice; - welcomed the decision of the Council of the European Union, on the basis of the privileged relationship between the EU and the EFTA States participating in the EEA and in the interest of maintaining homogeneity, to authorise the Commission, bearing in mind the Code of Conduct, to bring relevant declarations made by the Council and/or the Commission in the EU Council's minutes to the attention of the EFTA States participating in the EEA. 7.
