· Pursuant to recitals 11 and 12 of Regulation No 1080/2010 and Article 6 paragraph 9 of Council Decision 2010/427/EU establishing the organisation and functioning of the EEAS (the "EEAS Council Decision"), the EEAS staff at AD level shall, when the EEAS has reached its full capacity, be composed of at least one third of staff from national diplomatic services of EU Member States and of at least 60% permanent officials of the European Union.

Does Decision 377/2013/EU (1) of the European Parliament and of the Council of 24 April 2013 (‘the Decision’) infringe the general EU principle of equal treatment insofar as it establishes a moratorium on the requirements to surrender emissions allowances imposed by Directive 2003/87/EC (2) of the European Parliament and of the Council of 13 October 2003 (as amended by various instruments, including Directive 2008/101/EC (3) of the European Parliament and of the Council of 19 November 2008) in respect of flights between EEA states and almost all non-EEA states, but does not extend that moratorium to flights between EEA states and Switzerland?

92. Notes nevertheless that the EEAS as a new organisation which represents a major European ambition needs to be endowed with sufficient means; in this regard, appropriations for staff remunerations in 2012 need to take into account the actual vacancy rates in the autumn of 2011; calls on the EEAS to exert restraint when it comes to the future creation of high-ranking posts; believes that one way of achieving this could be to replace progressively Seconded National experts posts by permanent posts for Member States' civil servants; notes that Seconded National Experts (SNE) are not counted in the one third of EEAS staff at AD level; nevertheless, recalls the Council decision establishing the organisation and functioning of the EEAS which states that "by the expiry of the contract of an SNE transferred to the EEAS under article 7, the function will be converted into a temporary agent post in cases where the function performed by the SNE corresponds to a function normally carried out by staff at AD level, provided that the necessary post is available under the establishment plan"; moreover, stresses that operational requirements for establishing the EEAS with its own information technology systems in a new building need to be funded;

45. Recognises the important role of the AC as the foremost regional forum for cooperation for the whole Arctic region; recalls that, apart from the Member States Denmark, Sweden and Finland and the candidate country Iceland which are members of the Arctic Council, the Member States Germany, France, the UK, Netherlands, Spain and Poland are active permanent observers; affirms its commitment not to support any arrangements which exclude any of the Arctic EU Member States, candidate countries or Arctic EEA/ EFTA states; acknowledges the concrete work done in the working groups of the AC with the involvement of the observers and calls on the Commission and EU agencies to continue to actively engage in all relevant working groups whenever possible; favours strengthening the legal and economic base of the AC;

Decisions by the EEA Council shall be taken by agreement between the Community, on the one hand, and the EFTA States speaking with one voice, on the other.
