Although the procedure was initiated under the ECSC Treaty, since it was not possible in practice to adopt a final decision before 23 July 2002 (Belgium’s reaction to the comments from interested parties arrived only on 17 June 2002, and additional information was provided subsequently, see recital 4 of this Decision), the Commission made it clear, in its notice on certain aspects of the treatment of competition cases resulting from the expiry of the ECSC Treaty (15), that it would in such cases adopt a final decision under Article 88(2) of the EC Treaty (point 43 of the notice).
Même si la procédure a été ouverte au titre du traité CECA, au vu de l’impossibilité dans la pratique d’adopter une décision finale avant le 23 juillet 2002 [les commentaires de la Belgique sur les observations des tiers ne sont arrivés que le 17 juin 2002 et des informations complémentaires ont été fournies par la suite (voir considérant 4 de la présente décision)], la Commission a indiqué, dans sa communication sur certains aspects du traitement des affaires de concurrence résultant de l’expiration du traité CECA (15), qu’elle rendrait, en pareil cas, une décision finale en vertu de l’article 88, paragraphe 2, du traité CE (point 43 de la communication).

The Commission notes that the expiry of the ECSC Treaty does not affect the assessment of the compatibility of the notified measure with the common market since the changes in substantive law that have taken place as a consequence of the expiry of the ECSC Treaty (see in particular point 19 of the notice referred to in recital 56) have not affected the ban on regional investment aid.
La Commission relève que l’expiration du traité CECA est sans incidence sur l’évaluation de la compatibilité avec le marché commun de la mesure notifiée dans la mesure où les changements dans le droit matériel intervenus comme conséquence de cette expiration (voir notamment le point 19 de la communication citée au considérant 56), n’ont pas affecté la prohibition des aides régionales à l’investissement.

Thus, the Commission proposed a gradual transition of these two sectors into the Treaty establishing the European Community. The rules of this Treaty have applied to the coal and steel trade since the expiry of the ECSC Treaty.

Les orientations concernant un futur régime de soutien pour le charbon communautaire, à l'expiration du traité CECA, pourraient intégrer les deux objectifs fondamentaux qui se sont dégagés depuis la signature du traité, évoqués au point (1) ci-dessus.

8. INVITES the Commission to incorporate into its Energy Policy those provisions of the ECSC Treaty which have proved their value, notably the support for coal and steel research - even beyond the expiry of the ECSC Treaty - since this research contributes to the objectives assigned to energy policy in the White Paper (see Memorandum of the Consultative Committee on matters linked to the expiry of the ECSC Treaty in 2002 (1)).
8. INVITE la Commission à reprendre dans sa politique énergétique les dispositions utiles du traité CECA, notamment le soutien, au-delà de l'expiration de ce traité, des activités de recherche dans les domaines charbonnier et sidérurgique, qui contribuent aux objectifs que le livre blanc assigne à la politique énergétique [voir mémorandum du Comité consultatif CECA sur les aspects liés à l'expiration du traité CECA en 2002 (1)].
