Recognises the importance of the public sector in improving public access to less polluting public transport services, in developing basic economic sectors, particularly the energy sector, in industry and tourism, in promoting economic, social and regional cohesion, and in strengthening the state's role in market regulation, participation and intervention in cooperation with users' organisations, taking the lead in supplying services of general interest; stresses that, in most cases, public-private partnerships in this sector serve only to make business easier for economic groups and provide cover for privatisations that harm the interests of the public and of public transport service users;

In the view of the rapporteur, it is necessary to start to clarify the different concepts of public services and to distinguish between SGIs which are, on the one hand those of a commercial nature and mainly financed by the user, which the EC Treaty qualifies as services of general economic interest (SGEI) in line with Article 16 of the EU Treaty, and, on the other hand, those which are not of a commercial nature and are financed mainly by public or social funds, which may be regarded as services of non-economic general interest (SNEGI), such as services of general interest exercising exclusively social functions or prerogatives of public authorities.

It helps if you are running a business or a public service to know what the rules are, but I am appalled that this should hinge on defining the distinction between services of economic general interest and services of non-economic general interest.

However, contracting entities may decide that certain information on the contract award or the conclusion of the framework agreement or on admission to a dynamic purchasing system, referred to in the paragraph 1, is to be withheld where release of such information would impede law enforcement or otherwise be contrary to the public interest or would prejudice the legitimate commercial interests of a particular economic operator, public or private, including the interests of the economic operator to whom the contract has been awarded, or might prejudice fair competition between economic operators.

Article 53 states that the contracting authorities may only take account of whether the goods or services are the most economically advantageous for that contracting authority alone. The draftsman interprets this form of words to mean that account may be taken only of advantages directly accruing to the contracting authority and that public authorities are thus deprived of their scope for using the award of public contracts to take account of or further the public interest. If this interpretation is correct, the consequences would be undesirable as the procurement rules would undermine sustainable development and action in favour of the environment in the EU.
