IN-CONTEXT TRANSLATIONS

The European Commission is today issuing a favourable opinion on the European Central Bank's (ECB) recommendation of 23 June 2017, in which the ECB asked for a greater role in regulating clearing systems for financial instruments, for example with regard to central counterparties (CCPs), by proposing to amend Article 22 of its Statute.
La Commission européenne a rendu aujourd'hui un avis favorable sur la recommandation de la Banque centrale européenne (BCE) du 23 juin 2017, dans laquelle la BCE demandait à exercer un plus grand rôle dans la réglementation des systèmes de compensation d'instruments financiers, par exemple en ce qui concerne les contreparties centrales (CCP), et proposait à cet effet une modification de l'article 22 de ses statuts.

Notes that the ECB’s role is not sufficiently defined, as it is stated in the ESM Treaty and Regulation (EU) No 472/2013 that the Commission should work ‘in liaison with the ECB’, thus reducing the ECB to an advisory role; notes that the Eurogroup asked for the involvement of the ECB as a provider of expertise to complement the views of the other Troika partners, and that the ECJ has ruled in the Pringle case that the tasks allocated to the ECB by the ESM Treaty are in line with the various tasks which the TFEU and the Statute of the ESCB [and the ECB] confer on the ECB provided that a certain number of conditions are permanently fulfilled; points to the responsibility of the Eurogroup in allowing the ECB to act within the Troika, but recalls that the ECB’s mandate is circumscribed by the TFEU to the areas of monetary policy and financial stability and that involvement of the ECB in the decision-making process related to budgetary, fiscal and structural policies is not foreseen by the Treaties; recalls that Article 127 TFEU provides that, without prejudice to the objective of price stability, the ESCB shall support the general economic policies in the Union with a view to contributing to the achievement of the objectives of the Union as laid down in Article 3 TEU;

92. Requests that in any reform of the Troika framework the ECB’s role is carefully analysed, in order to align it with the ECB mandate; requests especially that the ECB be given the status of a silent observer with a transparent and clearly defined advisory role while, not allowing it to be a full negotiation partner and discontinuing the practice of the ECB co-signing mission statements;

Points out that a Treaty revision, including a revision of the ECB statutes reflecting the ECB’s new tasks, should not be excluded as a means to reflect the evolving nature of the EU institutional setting, the recent changes in the ECB’s role, the pressing accountability and oversight issues and the challenges prompted by the deepening of the Union;

By contrast, the ECB remains fully independent when exercising its initial role of being responsible for monetary policy in the Eurozone.

Believes that recognition of the European Central Bank (ECB) as a European institution, which does not affect its independence when conducting monetary policy, increases the responsibility of Parliament, and, in particular, that of its committee competent for economic and monetary affairs, as an institution to which the ECB accounts for its decisions on monetary policy; considers that there should be parallel reinforcement of Parliament’s contribution to the appointment of the members of the ECB Executive Board; takes the view that the ECB’s role in combating activities affecting the financial interests of the European Union should lead to close cooperation between Parliament’s committees;

This is also in the Treaty mandate of the ECB, and I think that the ECB’s role in financial supervision should be strengthened.

(7) Without prejudice to the ECB's role in the protection of the euro against counterfeiting, the Commission will carry out all consultations concerning the evaluation of needs for the protection of the euro with the principal parties involved (in particular the competent national authorities designated by the Member States, the ECB and Europol) within the appropriate advisory committee provided for in Regulation (EC) No 1338/2001, particularly as regards exchanges, assistance and training, for the purpose of implementing this programme.
(7) La Commission procède, sans préjudice du rôle dévolu à la BCE en matière de protection de l'euro contre le faux monnayage, à toutes consultations relatives à l'évaluation des besoins pour la protection de l'euro avec les principaux acteurs concernés (notamment les autorités nationales compétentes désignées par les États membres, la BCE et Europol) au sein du comité consultatif approprié prévu par le règlement (CE) n° 1338/2001, particulièrement en matière d'échanges, d'assistance et de formation, pour l'application du présent programme.

To this end, the Commission will continue, without prejudice to the role attributed to the ECB in protecting the euro against counterfeiting, on a regular basis, in an appropriate advisory committee, with the leading players in the fight against counterfeiting of the euro (including the ECB, the ETSC, Europol and Interpol), the consultations on improving the conditions for the overall protection of the euro on the basis of legislative initiatives to reinforce the prevention and combating of counterfeiting.
À cet effet, la Commission poursuivra, sans préjudice du rôle dévolu à la BCE en matière de protection de l'euro contre le faux monnayage, de façon régulière, au sein d'un comité consultatif approprié, avec les principaux acteurs de la lutte contre le faux monnayage de l'euro (notamment la BCE, le CTSE, Europol et Interpol), les consultations pour améliorer les conditions de la protection globale de l'euro sur la base d'initiatives législatives en vue de renforcer la prévention et la lutte contre le faux monnayage.
