The ECB and Eesti Pank agree to set Eesti Pank’s claim at EUR 103 115 678,01 in order to ensure that the ratio between the amount in euro of Eesti Pank’s claim and the aggregate amount in euro of the claims credited to the other national central banks of Member States whose currency is the euro (hereinafter the ‘other NCBs’) will be equal to the ratio between Eesti Pank’s weighting in the ECB’s capital key and the other NCBs’ aggregate weighting in this key.
La BCE et l’Eesti Pank conviennent de fixer la créance de l’Eesti Pank à 103 115 678,01 EUR afin de faire en sorte que le rapport entre le montant en euros de la créance de l’Eesti Pank et le montant global en euros des créances reçues par les autres banques centrales nationales des États membres dont la monnaie est l’euro (ci-après les «autres BCN») soit égal au rapport entre la pondération de l’Eesti Pank dans la clé de répartition du capital de la BCE et la pondération globale des autres BCN dans cette clé.

The ECB and Eesti Pank should agree on other modalities for crediting Eesti Pank’s claim, taking into account that, depending on exchange rate movements, it may be necessary to increase rather than reduce the claim to the amount referred to in recital 2.
La BCE et l’Eesti Pank doivent convenir d’autres modalités pour créditer la créance de l’Eesti Pank, dès lors que selon les variations des taux de change, il pourrait être nécessaire d’augmenter plutôt que de réduire ladite créance jusqu’à concurrence du montant mentionné au considérant 2.

The ECB and Eesti Pank shall each retain one original hereof.
La BCE et l’Eesti Pank en conservent chacune un exemplaire.

In view of the above mentioned difference, the ECB and Eesti Pank agree that Eesti Pank’s claim may be reduced by offsetting against it the amount that Eesti Pank is required to contribute to the ECB’s reserves and provisions pursuant to Article 48.2 of the Statute of the ESCB and Article 5(1) of Decision 2011/23/EU (ECB/2010/34), in the event that Eesti Pank’s claim is larger than the amount of EUR 103 115 678,01.
Eu égard à la différence mentionnée ci-dessus, la BCE et l’Eesti Pank conviennent que la créance de l’Eesti Pank peut être réduite par compensation du montant que l’Eesti Pank est tenue de verser au titre de contribution aux réserves et aux provisions de la BCE en vertu de l’article 48.2 des statuts du SEBC et de l’article 5, paragraphe 1, de la décision 2011/23/UE (BCE/2010/34), au cas où la créance de l’Eesti Pank serait supérieure à 103 115 678,01 EUR.

2. If the amount required to be contributed by Eesti Pank to the ECB’s reserves and provisions pursuant to Article 48.2 of the Statute of the ESCB and Article 5(1) of Decision 2011/23/EU (ECB/2010/34) is less than the difference between the amount of Eesti Pank’s claim and EUR 103 115 678,01, then the amount of the claim shall be reduced to EUR 103 115 678,01: (a) by offsetting in accordance with paragraph 1 above; and (b) by the ECB paying Eesti Pank an amount in euro equal to the amount of the shortfall remaining after such offset.
2. Si le montant que l’Eesti Pank est tenue de verser au titre de contributions aux réserves et aux provisions de la BCE en vertu de l’article 48.2 des statuts du SEBC et de l’article 5, paragraphe 1, de la décision 2011/23/UE (BCE/2010/34) est inférieur à la différence entre le montant de la créance de l’Eesti Pank et 103 115 678,01 EUR, le montant de la créance est réduit jusqu’à concurrence de 103 115 678,01 EUR et ce: a) par compensation conformément au paragraphe 1 ci-dessus; et 2) par versement de la BCE à l’Eesti Pank du montant, exprimé en euros, de l’insuffisance résiduelle après compensation.
