Appeal: against the judgment of the European Union Civil Service Tribunal (First Chamber) of 30 November 2009 in case F‑55/08 De Nicola v EIB [2009] ECR-SC I‑A‑1‑469 and II‑A‑1‑2529, seeking to have that judgment set aside.
Objet : Pourvoi formé contre l’arrêt du Tribunal de la fonction publique de l’Union européenne (première chambre) du 30 novembre 2009, De Nicola/BEI (F‑55/08, RecFP p. I‑A‑1‑469 et II‑A‑1‑2529), et tendant à l’annulation de cet arrêt.

Hence, given that special provisions exist, Article 27(2) is not applicable to the recovery of parliamentary allowances that have been unduly paid (see by analogy the judgments in Cases C‑469/93 Chiquita Italia [1995] ECR I‑4533, paragraph 61, and C‑444/00 Mayer Parry Recycling [2003] ECR I‑6163, paragraphs 49 to 57).
