The allegation of likelihood of recurrence of dumping for the United States of America (‘the country concerned’) is based on a comparison of domestic price with the export price (at ex-works level) of the product under review when sold for export to Canada, Brazil and Peru, in view of the current absence of significant import volumes from the United States of America to the Union.

By Implementing Regulation (EU) No 444/2011 (3), following an anti-circumvention investigation, the Council extended the definitive anti-dumping duty imposed by Regulation (EC) No 599/2009 to imports into the Union of biodiesel consigned from Canada, whether declared as originating in Canada or not, with the exception of those produced by the companies BIOX Corporation, Oakville and Rothsay Biodiesel, Guelph, Ontario, Canada.

As outlined in recital (2) above, the anti-dumping duties in force on imports of biodiesel from the USA were extended to cover also imports of the same product consigned from Canada, whether declared as originating in Canada or not, and to imports into the Union of biodiesel in a blend containing by weight 20 % or less of fatty-acid mono-alkyl esters and/or paraffinic gasoil obtained from synthesis and/or hydro-treatment, of non-fossil origin, originating in the United States of America.

The key changes in this bill include: rationalizing the investigative functions of Revenue Canada and the Canadian International Trade Tribunal; enhancing procedural fairness and transparency by harmonizing the way in which Revenue Canada and the tribunal treat the disclosure of confidential information; establishing new penalty provisions to deter any unauthorized disclosure or misuse of confidential information provided in the context of SIMA investigations; allowing expert witnesses to play a much more effective role in tribunal inquiries; improving the provisions that allow for the Deputy Minister of National Revenue to accept an undertaking from exporters to raise prices as an alternative to the imposition of anti-dumping duties; requiring the tribunal to cumulate the injurious effects of dumping or subsidizing from more than one country; and clarifying the conditions under which the tribunal can consider issues of a broader public interest and the very nature of the recommendations the tribunal may make.
