The derogations from Community rules (rates of public assistance to agricultural holdings and agri-food firms, the eligibility of State forests) granted by the Council on 28 June 2001 required the amendment of the programme complements for the four overseas departments and of the SPDs, which should be done in the first half of 2002.
Les dérogations à la réglementation communautaire (taux d'intervention publique dans les exploitations agricoles et dans les entreprises agroalimentaires, éligibilité de la forêt d'État) accordées par le Conseil le 28 juin 2001 ont nécessité la modification des compléments de programmation pour les quatre départements d'outre-mer ainsi que des DOCUP.

For this purpose, the Commission has decided to attack the main legal obstacle by giving a new interpretation to Article 296 of the Treaty, which stipulates that Member States are allowed to derogate from Community rules on competition for reasons of national security.

This is clearly a derogation from Community law, since there is a general principle in the field of VAT which consists in applying – unless there are derogations – the same taxes in a uniform fashion throughout the national territory.
