Pursuant to Standing Order 34(1), I have the honour to present, in both official languages, the “Report of the Canadian Parliamentary Delegation respecting its participation at Meetings of the Bureau of the IPU Committee on United Nations Affairs”, held in New York City on May 19, 2014; “Report of the Canadian Parliamentary Delegation respecting its participation at the Meeting of the Sub-Committee on Finance and the 269th (extraordinary) Session of the IPU Executive Committee”, held in Geneva, Switzerland, from June 29 to July 1, 2014; and “Report of the Canadian Parliamentary Delegation respecting its participation at the Parliamentary Meeting of the 20th International AIDS Conference”, held in Melbourne, Australia, from July 19 to 24, 2014.

(a) governing the administration, management and conduct of the affairs of the Commission; (b) governing the appointment of an auditor; (c) setting out the powers, functions and duties of the Chair, each Vice-Chair and the officers employed by the Commission; (d) delegating to employees of the Commission the exercise or performance of any power or duty conferred or imposed on an officer of the Commission under this Act and fixing the terms or conditions of the delegation; (e) governing the remuneration and benefits of the Chair, each Vice-Chair and the other members of the Commission; (f) governing the time, place and method for holding meetings of the board of directors and the procedures at such meetings; (g) governing the appointment, operation or dissolution of committees of the board of directors and delegating duties of the board to the committees; and (h) governing the refund of fees paid to the Commission under this or any other Act and authorizing employees of the Commission to approve refunds subject to such conditions and in such circumstances as the Commission considers appropriate.

While the Committee is pleased that certain elements of its previous opinions have been taken up in the drafting of the proposals under consideration here, it reiterates the point it made recently that ‘in accordance with Article 290 TFEU, the duration of the delegation of power must be explicitly defined in the basic legislative act, and that until now, with very few exceptions, delegations have in principle always been granted for a specific period, renewable where necessary, with a requirement for a report on the implementation of the delegation’ (10).
Tout en se félicitant que différents éléments figurant dans ses précédents avis aient été pris en compte dans la formulation des propositions à l'examen, le Comité réitère sa récente prise de position, à savoir que «selon l’article 290 du TFUE, la durée du pouvoir de délégation doit être explicitement prévue par l’acte législatif de base et que jusqu’à présent, à quelques rares exceptions près, les délégations sont en principe fixées pour une durée déterminée, le cas échéant renouvelable, moyennant un rapport sur l’exécution de la délégation» (10).

The Committee points out that the European Parliament itself in its Resolution of 5 May 2010 on the power of legislative delegation highlighted the delicate nature of the delegation procedure, stressing that ‘the objectives, content, scope and duration of a delegation pursuant to Article 290 TFEU must be expressly and meticulously defined in each basic act’.
Le CESE rappelle que dans sa résolution du 5 mai 2010 sur le pouvoir de délégation législative, le Parlement européen a lui-même pointé le caractère délicat de la délégation et souligné que «les objectifs, le contenu, la portée et la durée de la délégation de pouvoir, en vertu de l'article 290 du traité FUE, doivent être explicitement et méticuleusement définis dans chaque acte de base».

Moreover, the Committee believes that adaptation to the delegation procedure should be approved only where there is a need to ‘adopt non-legislative acts of general application to supplement or amend certain non-essential elements of the legislative act’ under Article 290 and, in the case of purely implementing acts, the provisions of Article 291 TFEU must be applied, while ‘the essential elements of an area’ should never be subject to delegation.

Any member of the Committee who is unable to attend a Committee session or a section meeting may, after notifying the president concerned, delegate his voting right, in writing, to another member of the Committee or section.
