Article 290 of the Treaty on the Functioning of the European Union (hereinafter ‘TFEU’) provides that a legislative act may delegate to the Commission the power to adopt non-legislative acts only to supplement or amend certain non-essential elements of the legislative act.

Under Article 290 of the Treaty on the Functioning of the European Union (hereinafter ‘TFEU’) a legislative act may delegate to the Commission the power to adopt non-legislative acts only to supplement or amend certain non-essential elements of the legislative act.

In order to supplement or amend certain non-essential elements of this Regulation, the power to adopt delegated acts in accordance with Article 290 of the Treaty on the Functioning of the European Union (TFEU) should be delegated to the Commission in respect of the accreditation of the paying agencies and coordinating bodies, the obligations of the paying agencies in relation to public intervention, as well as the rules on the content of the management and control responsibilities of those agencies, the measures to be financed by the general budget of the European Union (the Union's budget) under public intervention and the valuation of the operations in connection with public intervention.
Afin de compléter ou de modifier certains éléments non essentiels du présent règlement, il importe de conférer à la Commission le pouvoir d'adopter des actes délégués conformément à l'article 290 du traité sur le fonctionnement de l'Union européenne, en ce qui concerne l'agrément des organismes payeurs et des organismes de coordination, les obligations des organismes payeurs en ce qui concerne l'intervention publique, ainsi que les règles sur la teneur de leurs responsabilités en matière de gestion et de contrôle de ces organismes, les mesures à financer sur le budget général de l'Union européenne (ci-après dénommé "budget de l'Union") au titre de l'intervention publique et l'évaluation des opérations y afférentes.

6. Considers that while a decision not to delegate certain non-essential elements – and to keep instead any changes thereto in the ordinary legislative procedure – may be an appropriate solution in some cases (in that it respects the prerogatives of both the Council and Parliament), it would not be appropriate in other cases where it would be disproportionate to the nature of the non-essential element to be amended, and would thus, de facto, act as a brake on what may well be important adaptations;

A. whereas the Treaty of Lisbon provides for a new hierarchy of norms consisting of legislative acts, in which the legislator decides on essential elements, delegated acts, to be adopted by the Commission under the control of the legislator to amend or supplement certain non-essential elements of legislative acts and implementing acts, which are normally to be adopted by the Commission under the control of Member States where uniform conditions for the implementation of Union acts are required;

In order to supplement or amend certain non-essential elements of this Regulation, the power to adopt delegated acts in accordance with Article 290 TFEU should be delegated to the Commission.

It gives the legislator the possibility to delegate on the Commission the power to adopt non-legislative acts of general application to supplement or amend certain non-essential elements of the legislative act.

(3) The Commission should have the power to adopt delegated acts in accordance with Article 290 of the Treaty in order to supplement or amend certain non-essential elements of Regulation (EC) No 1290/2005. The elements for which that power may be exercised and the conditions to which that delegation must be subject should be defined. In order to ensure the proper functioning of the regime established by Regulation (EC) No 1290/2005, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of supplementing or amending certain of its non-essential elements.
