TRADUCTIONS EN CONTEXTE

This Directive is without prejudice to the Member States’ competence to provide for the funding of public service broadcasting in so far as such funding is granted to broadcasting organisations for the fulfilment of the public service remit as conferred, defined and organised by each Member State in accordance with Protocol No 29 on the system of public broadcasting in Member States annexed to the TFEU and the TEU.
La présente directive s’entend sans préjudice de la compétence des États membres de pourvoir au financement du service public de radiodiffusion dans la mesure où ce financement est accordé aux organismes de radiodiffusion aux fins de l’accomplissement de la mission de service public telle qu’elle a été conférée, définie et organisée par chaque État membre conformément au protocole no 29 sur le système de radiodiffusion publique dans les États membres annexé au traité sur le fonctionnement de l’Union européenne et au traité sur l’Union européenne.

The possibility open to Member States to define broadcasting SGEIs broadly so as to cover the broadcasting of full-spectrum programming cannot be called into question by the fact that the public service broadcaster also engages in commercial activities, in particular the sale of advertising space. Indeed, the question of the definition of the public service remit must not be confused with the question of the financing mechanism chosen to provide that service (64).
La possibilité pour un État membre de définir les services d’intérêt économique général en matière de radiodiffusion dans une acceptation large couvrant l’émission de programmes très variés ne saurait être remise en question par le fait que l’opérateur de service public exerce également des activités commerciales, notamment la vente d’espaces publicitaires. In its judgment, the Court ruled that the Member States’ power to define broadcasting SGEIs in broad qualitative terms, so as to cover the broadcasting of a wide range of programmes, cannot be disputed, nor can the Member States’ freedom to use advertising revenue to finance such SGEIs (63).

Public-service broadcasters should, for the purposes of this Directive, cover broadcasters with a public-service remit as conferred, defined and organised by each Member State.

The interpretation of these provisions in the light of the particular nature of the broadcasting sector is outlined in the Amsterdam Protocol, which, after considering ‘that the system of public broadcasting in the Member States is directly related to the democratic, social and cultural needs of each society and to the need to preserve media pluralism’, states that ‘the provisions of the Treaty establishing the European Community shall be without prejudice to the competence of Member States to provide for the funding of public service broadcasting insofar as such funding is granted to broadcasting organisations for the fulfilment of the public service remit as conferred, defined and organised by each Member State, and insofar as such funding does not affect trading conditions and competition in the Community to an extent which would be contrary to the common interest, while the realisation of the remit of that public service shall be taken into account’.
L'interprétation de ces dispositions au regard des caractéristiques particulières du secteur de la radiodiffusion est soulignée dans le protocole d'Amsterdam, qui, après avoir tenu compte du fait «que la radiodiffusion de service public dans les États membres est directement liée aux besoins démocratiques, sociaux et culturels de chaque société ainsi qu'à la nécessité de préserver le pluralisme dans les médias», établit que: «Les dispositions du traité instituant la Communauté européenne sont sans préjudice de la compétence des États membres de pourvoir au financement du service public de radiodiffusion dans la mesure où ce financement est accordé aux organismes de radiodiffusion aux fins de l'accomplissement de la mission de service public telle qu'elle a été conférée, définie et organisée par chaque État membre et dans la mesure où ce financement n'altère pas les conditions des échanges et de la concurrence dans la Communauté dans une mesure qui serait contraire à l'intérêt commun, étant entendu que la réalisation du mandat de ce service public doit être prise en compte».

In the specific case of public broadcasting the above approach has to be adapted in the light of the interpretative provisions of the Amsterdam Protocol, which refers to the ‘public service remit as conferred, defined and organised by each Member State’ (definition and entrustment) and provides for a derogation from the Treaty rules in the case of the funding of public service broadcasting ‘insofar as such funding is granted to broadcasting organisations for the fulfilment of the public service remit (.) and (.) does not affect trading conditions and competition in the Community to an extent which would be contrary to the common interest, while the realisation of the remit of that public service shall be taken into account’ (proportionality).

The provisions of the Treaties shall be without prejudice to the competence of Member States to provide for the funding of public service broadcasting and in so far as such funding is granted to broadcasting organisations for the fulfilment of the public service remit as conferred, defined and organised by each Member State, and in so far as such funding does not affect trading conditions and competition in the Union to an extent which would be contrary to the common interest, while the realisation of the remit of that public service shall be taken into account.

When defining ‘producers who are independent of broadcasters’ as referred to in Article 5 of Directive 89/552/EEC, Member States should take appropriate account notably of criteria such as the ownership of the production company, the amount of programmes supplied to the same broadcaster and the ownership of secondary rights.

(14) Whereas the legal uncertainty regarding the rights to be acquired which impedes cross-border satellite broadcasting should be overcome by defining the notion of communication to the public by satellite at a Community level; whereas this definition should at the same time specify where the act of communication takes place; whereas such a definition is necessary to avoid the cumulative application of several national laws to one single act of broadcasting; whereas communication to the public by satellite occurs only when, and in the Member State where, the programme-carrying signals are introduced under the control and responsibility of the broadcasting organization into an uninterrupted chain of communication leading to the satellite and down towards the earth; whereas normal technical procedures relating to the programme-carrying signals should not be considered as interruptions to the chain of broadcasting;
