In order to meet the exceptional circumstances of the transition to the decommitment rules introduced by this Regulation, appropriations which have been cancelled because of decommitments made by the Commission for the financial year 2007 in the implementation of Article 93(1) and Article 97 of Regulation (EC) No 1083/2006 as amended by Regulation (EC) No 284/2009, pursuant to Article 11 of the Financial Regulation, shall be reconstituted to the extent necessary for the implementation of the second subparagraph of Article 93(1) of Regulation (EC) No 1083/2006 as amended by this Regulation.

40. Recalls the Joint Declaration adopted in conciliation last November, calling for a simplification of implementing procedures and urging the Member States to make use of the possibility of revising their operational programmes in order better to address the effects of the economic crisis; welcomes, in this respect, the current revision of the General Regulation on Structural Funds 2007-2013 (Regulation (EC) No 1083/2006) that aims at improving simplification in the management of the funds as well as introducing measures to enable Member States tackle the consequences of the economic crisis; requests that these provisions are implemented without further delay in the Member States; calls on the Commission to estimate the possible impact on payment appropriations of the new provisions, as well as to assess the effect of the proposed derogation from the automatic decommitment (N+2, N+3) rule on the budget;
40. rappelle la déclaration commune adoptée en conciliation en novembre 2009, qui appelle à une simplification des procédures d'exécution et exhorte les États membres à faire usage de la possibilité de réviser leurs programmes opérationnels afin de mieux faire face aux effets de la crise économique; salue, à cet égard, la révision en cours du règlement général sur les fonds structurels pour la période 2007-2013 (règlement (CE) n° 1083/2006) qui vise à renforcer la simplification dans la gestion des fonds ainsi qu'à introduire des mesures propres à permettre aux États membres de remédier aux conséquences de la crise économique; demande que les États membres mettent en œuvre ces dispositions sans tarder davantage; demande à la Commission d'évaluer l'impact potentiel des nouvelles dispositions sur les crédits de paiement ainsi que l'incidence de la proposition de dérogation à la règle de dégagement automatique (N+2, N+3) sur le budget;

As regards some components of Council Regulation (EC) No 1085/2006 of 17 July 2006 establishing an Instrument for Pre-Accession Assistance (IPA) (3) and the Regulation (EC) No 1638/2006 of the European Parliament and of the Council of 24 October 2006 laying down general provisions establishing a European Neighbourhood and Partnership Instrument (4), in the event of multi-annual programmes using split commitments, the Financial Regulation introduced a ‘n+3’ decommitment rule in Article 166(3)(a) of the Financial Regulation.
En ce qui concerne certains volets du règlement (CE) no 1085/2006 du Conseil du 17 juillet 2006 établissant un instrument d'aide de préadhésion (IAP) (3) et du règlement (CE) no 1638/2006 du Parlement européen et du Conseil du 24 octobre 2006 arrêtant des dispositions générales instituant un instrument européen de voisinage et de partenariat (4), en cas de programmes pluriannuels recourant à des engagements fractionnés, le règlement financier a instauré une règle de dégagement en «n + 3» à l'article 166, paragraphe 3, point a), du règlement financier.

The Cohesion Fund will be covered by the new general regulation from 2007 and two important changes will be introduced: The Cohesion Fund will be managed through programmes rather than on a project by project basis; and the automatic decommitment rule will apply to Cohesion Fund programmes as to all others.
