When, even in the current climate, I hear criticism from some national governments for an over-dramatic assessment of the situation and the lessons to be learned from it, while others say it is high time I took decisive action, then I prefer to take a middle course.

While it is indeed true, as the French Republic has maintained, that, at the very least as from 24 June 2008, the Council could not possibly allow a situation to continue in which Decision 2007/868 lacked any basis, but had as soon as possible to take appropriate action, the fact nevertheless remains, as indeed that Member State accepts and as the General Court rightly pointed out at paragraph 42 of the judgment under appeal, that neither the judgment of the Court of Appeal nor the Home Secretary’s order of 23 June 2008 had an automatic, immediate effect on Decision 2007/868, then applicable.

This decision was then followed by other very significant events at international level, such as the Heiligendamm G8 Summit, the UN Security Council's debate on the impact of climate change on peace and security, the meeting of the world's major emitters convened by the US, the Nobel Peace Prize Award to Al Gore and the IPCC scientists, Australia’s ratification of the Kyoto Protocol and, finally, the adoption of the “Bali action plan” which will, hopefully, lead to the conclusion in Copenhagen, in December 2009, of a new international climate change agreement.

Moreover, setting aside the judgment under appeal will, in any event, procure a definite advantage for the Commission inasmuch as, if the action at first instance is ultimately dismissed, it will then be protected from an action for damages by Mr Meierhofer on account of the loss he could claim to have suffered by reason of the decision of 19 June 2007 (see, to that effect, Parliament v Richard, paragraph 34, and Parliament v Samper, paragraph 31, both cases cited in paragraph 41 above).
