On 26 May 2015, the Council adopted Decision (CFSP) 2015/818 (2) amending Decision 2011/137/CFSP taking into consideration the threat that continues to be posed to the peace, stability or security of Libya and the successful completion of its political transition, inter alia through the exacerbation of current divisions by persons and entities identified as having been involved in the repressive policies of the former regime of Muammar Qadhafi in Libya, or otherwise formerly associated with that regime, and given that most of those persons or entities have not been held accountable for their actions.

With regard to the persons listed in Annex IV to Decision 2011/137/CFSP, in order to facilitate the return of misappropriated funds to the Libyan State, the derogations provided for in Decision 2011/137/CFSP should be amended to permit the release of certain frozen funds or economic resources where they are required to satisfy a judicial or administrative decision rendered in the Union, or a judicial decision enforceable in a Member State, prior to or after the date of designation of the persons, entities and bodies concerned.
En ce qui concerne les personnes figurant sur la liste de l'annexe IV de la décision 2011/137/PESC, il convient, pour faciliter le rapatriement vers l'État libyen de fonds détournés, de modifier les dérogations prévues dans la décision 2011/137/PESC afin de permettre le déblocage de certains fonds ou ressources économiques gelés lorsqu'ils sont nécessaires aux fins d'une décision judiciaire ou administrative rendue dans l'Union ou d'une décision judiciaire exécutoire dans un État membre, avant ou après la date de la désignation des personnes, entités et organismes concernés.
